, <br /> 8 <br /> 9.3.6 Identification of Funding Contributor <br /> At the time of Project construction, the City shall provide on-site signage, <br /> mutually acceptable to both parties,that identifies Sound Transit as a <br /> funding contributor to the Project. <br /> 10. CONTRACT ADMINISTRATION <br /> The Parties shall be solely responsible for the execution, administration, and <br /> fulfillment of any contracts they enter into for the performance of its <br /> responsibilities under this Agreement. In no event shall any such contract be <br /> construed as obligating the other Party. All consultant contracts shall comply with <br /> applicable FTA,public works and procurement laws and regulations, including <br /> but not limited to, bonding, prevailing wage, nondiscrimination, retainage <br /> requirements, insurance, and workers compensation. <br /> 10.1 Opportunity for Small Business <br /> In accordance with the City's Guiding Principles for Employment and Contracting <br /> and in accordance with the City's Disadvantaged Business Enterprise (DBE) <br /> Program, the City has set diversity objectives for M/W/DBE and Small Business <br /> Participation, and Equal Employment Opportunity (EEO) consistent with those <br /> policies that have been approved by the Federal Transit Authority. Consistent with <br /> its program and policies, the City will assist vendors and contractors in identifying <br /> and maximizing business opportunities (in whole or part) for Minority-owned, <br /> Women-owned, and Disadvantaged Business Enterprise (M/W/DBE) and Small <br /> Businesses to participate and compete for contracts. The City further agrees to <br /> assist vendors and contractors in understanding the requirements under the EEO <br /> laws. <br /> 11. PERFORMANCE MONITORING AND REPORTING <br /> The Parties shall communicate regularly to discuss the status of the tasks and <br /> services to be performed and to resolve any issues or disputes related to the <br /> successful performance of this Agreement. The City shall provide Sound Transit <br /> a Monthly Project Status Report(a written summary of progress on the schedule <br /> and key milestones covered by this Agreement). The specific format and timing <br /> for this information will be developed to meet the Project Management Team's <br /> needs. <br /> 12. DISPUTE RESOLUTION <br /> Sound Transit and the City will work collaboratively to resolve disagreements <br /> arising from activities performed under this Agreement.
