ORDINANCE NO. <br /> AN ORDINANCE providing for the vacation of a <br /> porton or 25" lying south of 101 Ave. S.E. and north of <br /> 104 PI. S.E. <br /> WHEREAS, the City Council of the City of Everett, did by Resolution No. 5535 <br /> duly adopt and fix the 3rd day of November, 2004 at 6:30P.M., as the date of public <br /> hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said Resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, the issues were publicly <br /> presented; and <br /> WHEREAS, the City Council kids it would not vacate said rights of way could it <br /> not retain easements for utilities in 25 Drive S.E., to be vacated; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the said <br /> right of way resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance: <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: <br /> That the following described right-of-way: <br /> The East 20 feet of the North One-Half of the Southwest Quarter of the <br /> Northeast Quarter of the Northwest Quarter of Section 20, Township 28 <br /> North, Range 5 East W.M., and <br /> The West 20 feet of the Southeast Quarter of the Northeast Quarter of the <br /> Northwest Quarter of Section 20, Township 28 North, Range 5 East W.M. <br /> All situate in the City of Everett, County of Snohomish, Washington <br /> be and the same is hereby vacated pursuant to the conditions set forth in this <br /> ordinance. <br /> 50 <br />
