9 <br /> incorporated by reference. <br /> CITY Elects Service Level II <br /> (c). Service Level III — The CITY may Book and house inmates if the Jail has space <br /> available. The COUNTY reserves the right to limit Bookings from the CITY for operational <br /> or other reasons. <br /> CITY Elects Service Level III <br /> Section 4. Term <br /> This agreement shall be in effect from the later of January 1, 2005 or the actual date that the <br /> CITY's signed copy of this agreement is received by the COUNTY and shall continue until <br /> December 31, 2009, or until terminated by either party in accordance with Section 5, PROVIDED <br /> that the COUNTY'S obligations are contingent upon local legislative appropriation of necessary <br /> funds in accordance with applicable laws and the Snohomish County Charter. Upon signature, this <br /> Agreement shall supersede all previous contracts and agreements between the parties relating to the <br /> Jail and jail services. <br /> Section 5. Termination <br /> (a). Service Level I or II—In the event that either party desires to terminate this <br /> agreement, one year's written notice shall be provided to the other party involved. <br /> (b). Service Level III—In the event that either party desires to terminate this <br /> agreement, ninety (90) days' written notice shall be provided to the other party involved. <br /> (c). Should the CITY wish to reduce its Service Level, the CITY must terminate this <br /> Agreement and the appropriate termination period will apply. Any new agreement between <br /> the COUNTY and the CITY will be a matter of negotiation. The CITY will have no vested <br /> rights to a new agreement. <br /> (d). Should the CITY wish to increase its Service Level, the CITY may request an <br /> amendment to this Agreement which shall be a matter of negotiation between the COUNTY <br /> and the CITY. The CITY will have no vested rights to such amendment or to a new <br /> agreement. <br /> Section 6. . Population Level Limitation <br /> In the event that the Jail's maximum acceptable population level is reached, the COUNTY <br /> will work with the Jail Advisory Board to mitigate the impact to the Cities.
