iv <br /> Planning Commission Minutes <br /> March 8, 2005 <br /> Approved <br /> Chairman, Earl Dutton, called the meeting to order at 6:30 p.m. Other Commissioners attending <br /> were Claire Olivers, Si Newland, Carol Lorioux Loup, Michelle Trautman, CJ Ebert, and David <br /> Simpson. <br /> Commissioners not present: Lyle Ryan <br /> City staff members present were Allan Giffen, Dave Koenig, Gerry Ervine, Faheem Siddiq, and <br /> Kathy Davis of the Planning Department. <br /> Item#1: Public Hearing and Recommendation on Rezone and Height Change from the <br /> East Side of Rucker from Everett Avenue to Pacific Avenue <br /> Allan Giffen, Planning Director, stated that the request was initiated by the Mayor and referred <br /> to Planning Commission. The item had been on the agenda on October 19, 2004 as a <br /> discussion item and on November 16, 2004 as a nonagenda item. The minutes from those <br /> previous meetings have been included in Planning Commission packets. On October 19th, the <br /> Commission asked staff about taking a broader look at allowable building heights throughout the <br /> downtown. At the subsequent meeting on the 16th, Commission provided direction to take a <br /> look at the smaller specific area. Since that discussion, on November 16, 2004 the City Council <br /> and Budget Committee have authorized staff to conduct a downtown planning study. Currently, <br /> the scope and the boundaries of that downtown planning effort have not been determined and <br /> there will be more work in the upcoming months. Along with that continued work, staff will brief <br /> Planning Commission throughout the process on the downtown planning efforts. He mentioned <br /> that the current rezone request would be an interim step until such time that the downtown plan <br /> is completed. He then introduced Faheem Siddiq, staff planner, who would be providing a more <br /> detailed presentation. <br /> Faheem Siddiq, Land Use Senior Planner, stated that the site is zoned C-1 and is proposed to <br /> be rezoned to B-3 which will increase building height from 80 feet to 150 feet. The Staff Report <br /> was prepared to address the evaluation criteria for a nonproject rezone, will address a number <br /> of comprehensive plan policies which support the rezone request, will identify two businesses <br /> that will become legally nonconforming if the area is rezoned from C-1 to B-3, and will provide a <br /> reasonable basis for the planning commission to support the proposed rezone application. The <br /> decision is only a recommendation to City Council. He stated that the current proposal only <br /> involved the east side of Rucker from Everett to Pacific Avenues, was a nonproject rezone, and <br /> that no formal development application had been submitted in conjunction with the rezone <br /> application. He stated that this was an interim rezone for a small area, which will be included in <br /> a future evaluation of zoning and building heights for all of the downtown area. Also, the <br /> proposed rezone and amendment was initiated by Mayor Stephenson to allow Planning <br /> Commission and City Council to consider changes to zoning boundaries that are currently split <br /> between existing ownerships. <br /> B-3 Zone Map 22-1, EMC <br /> He showed where the property was located and stated that the proposal was to rezone two C-1 <br /> areas on the east side of Rucker that are separated by B-3 zoning.
