6 <br /> GCA 4386 <br /> City of Everett Project Support <br /> I 5 Everett, SR 526 to US 2 HOV Lanes <br /> THIS AGREEMENT is made and entered into this day of <br /> ,between the STATE OF WASHINGTON,Department of <br /> Transportation, hereinafter called the "STATE," and the City of Everett, 2930 Wetmore <br /> Avenue,Everett, WA 98201, a municipal corporation hereinafter called the "CITY." <br /> WHEREAS, the STATE is developing the Design-Build project,titled I-5 <br /> Everett, SR 526 to US 2 HOV Lanes, to add a northbound and southbound HOV lane <br /> from SR 526 to SR 2 and an auxiliary lane from the 41st Street Interchange to SR 2, <br /> hereinafter called the"PROJECT,"and <br /> WHEREAS, the STATE and CITY agree that it is to the benefit of both <br /> PARTIES that the STATE place on staff a CITY employee to serve as consultant and <br /> liaison to provide support to the PROJECT, and <br /> WHEREAS,RCW 39.34.080 authorizes a public agency to contract with another <br /> public agency to perform any governmental service which each public agency is <br /> authorized to perform, <br /> NOW, THEREFORE, in consideration of the terms, conditions, and performances <br /> contained herein , IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. GENERAL <br /> 1.1 The CITY agrees to assign to the STATE one CITY employee, subject to STATE <br /> approval,to provide support to the PROJECT. The PARTIES agree that this <br /> employee's work in support of the PROJECT is of benefit to both PARTIES; <br /> therefore,the PARTIES agree that the STATE shall pay a flat-rate, <br /> reimbursement cost of$48.00 per hour worked. The PARTIES agree that$48.00 <br /> per hour worked flat-rate includes, but is not limited to, all costs associated with <br /> medical insurance, travel expenses, administrative costs, overtime,retirement <br /> contributions, sick leave and vacation, and labor and industry payments <br /> (collectively called"benefits"). <br /> 1.2 The STATE's Project Engineer shall be solely responsible for assigning work to <br /> the CITY employee, and the STATE may require the employee to work in excess <br /> of 40 hours per week. <br /> 2. CITY RESPONSIBILITIES <br /> 2.1 The CITY agrees to pay the CITY employee and administer all employee <br /> benefits in the same manner as all other CITY employees. <br /> 24 <br />
