6 <br /> 2.2 The CITY agrees to require the CITY employee to submit a bi-weekly accounting <br /> to the Project Engineer of actual hours worked. The Project Engineer, or his/her <br /> designee,will review the hours worked, and if accurate, approve reimbursement <br /> to the CITY at the mutually agreed upon rate of$48.00 per hour. It is agreed that <br /> the STATE shall not reimburse the CITY for employee overtime payments, or <br /> any additional compensation or benefit provided to the employee by the CITY. <br /> 2.3 The PARTIES agree that, should either PARTY choose to cancel the services of <br /> the assigned CITY employee,the CITY shall timely provide a replacement <br /> employee, subject to STATE approval. The CITY also agrees that during the <br /> interim when a CITY employee is not permanently assigned pursuant to this <br /> AGREEMENT,the CITY will provide a temporary employee to the PROJECT <br /> until the permanently assigned employee position is filled. The temporary <br /> employee will report to the STATE's Project Engineer and perform the <br /> assignment of work. The STATE's permanently assigned employee <br /> reimbursement rate shall remain the same for temporarily assigned employees. <br /> 3. STATE RESPONSIBILITIES <br /> 3.1 The STATE shall provide the CITY employee a workstation in the project office, <br /> shared by the STATE and the STATE's contractor, or at a location agreed upon <br /> by the CITY and STATE. All formal communications between the CITY <br /> employee and the STATE's contractor shall be through the STATE's Project <br /> Engineer or his/her designee. <br /> 3.2 In the event the STATE finds it necessary to cancel the services of the CITY <br /> employee, the STATE will provide the CITY ten (10) days written notice. <br /> 4. PAYMENT <br /> 4.1 The STATE, in consideration of the faithful performance of work to be done by <br /> the CITY employee, agrees to pay the CITY an all-inclusive flat rate of$48.00 <br /> per hour for all hours worked. The$48.00 per hour rate shall serve as full <br /> compensation to the CITY for each hour of work performed by the CITY <br /> employee, up to a1naximam of 4166 hums. <br /> 4.2 The maximum amount payable by the STATE to the CITY under this <br /> AGREEMENT is $200,000. <br /> 4.3 The CITY agrees to submit a monthly billing to the STATE summarizing the <br /> hours worked each day by the CITY employee. The STATE agrees to pay the <br /> CITY within 30 days of receipt of an approved invoice. <br /> 25 <br />
