Ttte Applicant also requested an accesa off Evergreen Way near <br /> the center portion of Phase iI as it fronts Evergreen Way. <br /> o ., <br /> " " R� , 12. The City initially ob�ected to access off Evergreea for Phase II and <br /> z H � I wanted the access limited to the access from Wilmingtoa Avenue and 47th <br /> � y � '�, Street. The Applicant argued that some accese off Evergreen Way must be <br /> � I provlded for the site to be effective. <br /> N <br /> C y <br /> ,� ro r � 13. The Applicant indicated that 6arriers or projections could fie used to <br />� � ,� y ! prevent direct acress from Phase II to the southbound laues of Evergree¢ <br /> y Way. The Applicant stated that the access from the site to Evergreen <br />� i Way could be restricted to a r'.bht-hand tum norYh direction only. <br /> 14. The City indicated that further study would have to be made to revieW <br /> ' the proposed egress from Phase II to the northbound lanes of Evergreen <br /> IWay. The City indicated that elimination of left-hand turns onto <br />� i Evergreen Way may be appropriate. <br /> I15. In addition to the access points as mentioned, the Appllcant proposed a <br /> I left tum lane from the southbound lanes of Evergreen Way onto <br /> � Wilmington Avenue in order to provide direct access to Ptuises I and <br /> t <br /> � u' <br /> ���r� ; 16. At the public hearing testimony was submitted as follows: <br /> �� i <br /> � • Mike Brust - The witness stated that he lives east of the site. He <br /> 1 � stated that many of the delivery trucks that use the alley east of Phase <br /> � '�... I and SOth Street are disruptive to the neighborhood. He sutmitted that <br /> ��� � there �hould be some restrictio¢s for delivery trucks to travel east <br /> , � through the adjoining neighborhoods, and, that all delivery trucks <br /> i should have to access onto Evergreen Way. The witness su6mitted that <br /> '�� i the closure of Wilmington Avenue is supported by the neighborhood. He <br /> � �� contended that Wilmington Avenue should not be a source of access for <br /> ' delivery Crucks. <br /> � CONCLUSIONS <br /> I <br /> ��. <br /> � <br /> �� I 1. The appllcation is for the approval o£ an amendment to a contract rezone <br /> 1 for the development af property fcom 47th to SOth Street o¢ Evergreeu <br /> � Way, °verett, Washing[on. The original contract rezone entered between <br /> +� _ � , � the City and the Applicant's predecessor on August 12, 1989, allowed for <br /> � I co�ercial developmenr of the site conaistent vrith the conditions of the <br /> I I , rezone. :tro ameudm•ants to the rezone have heen approved by the City. <br /> '� i The Applicant'e rcquest is for a rezove to cteate a development that is <br /> more consistent with the new zoning codes of the City of Everett and <br /> �'`�� i minor changes in the permitted uses, parking, laadecaping, and signing. <br /> � <br />
