— '1
(Talk about Family FC complaints, S55 improvement vs POA, large blocks of
undeveloped property lends well to LID).
Of the completed projects on EvergreP Way that were required to provide for
standard Evergreen Way street improvemeats, 4 of tnem are within 1000 feet of
the subject property. One of them is thr: 7ohn Corbett property where Humphrey
VW is located. This site is directly across the street f.ror the Bolser site. And 7..,r,.ti--ts
iws requit ed and conditioned on the ohn Corbett property as a result of a street ""d- o
vacation action (tiighway Place). 7he other street vacation action was the ,'.
Wilmington Street vacation requested by Dr. C.urren. It also resulted in r".,
Evergreen Way frontage improvements. [n other city discretionary actions there "
was Fred Meyer Rezone; the Glacier Lanes Rezone; C,ascade Shopping Center .. .
Phase Il. All of them lead to required standard improveients. '

N 2
Our interpretation of City Council's Everreen Polic puts us in a osition , '"
that h=s resulted in nearly 50 rp ojects ba-in requireci to install standard m o
, Everreen Way improvements. c
O 3
m
7hat interpretation is that st is City Council's determination that rp oject = .=-i
where street improvements can be required - those improvements will be "'
required. The 5 year track record has been establlshed both by staff in non- c Z
discretionary actions and by Cly Council in discretionary actions. rD =
1--1 M

If our in:erpretation is not correct, coe need further direction from City Council. ` „
 a
Last: The Bolser Rezone project has been through the iill prior to the recent - m
court action. The vergreen Way street improvement condition is not something m .-
punitive and the condition is not new. This condition was an original staff o `"
recomrnendation based on City Council policy, based on 555, based on y
redevelopment impact on Evergreen Way, and the H.E. recomrraendation that a c
went to Council contained that condition. z c
—i r
• m
Tf the rezone is granted (which appears to be the case) then the Everg;•een Way
street improvement condition :iould be applied. -i
x
A
The applicant originally did not object to the improvement, just to the timing of '
installing the improvement. And it is pure nonsensc tu say that th frontage of s
the rezone is Flemmingo The commercial use requested is a use that attaches to
the Evergreen Way propetty. it does not attach to the single family use fronting o
on Flemming. Explain. --i
..

m
Evergreen Way is not a City Council policy so much as it is an Eve-green Way
property owner-merchant policy. 'fhe policy was recommended by the Evergreen
Way owners and merchants after years cf work and input from those owners and
merchants.
One more point is that City Council had determined that there would be no City
initiated LIDs on Evergreen 14'ay north of Intercity Avenue. So Mr. Bolser's offer
to pruvide a POA would not be useful to the City.
,r cvu"_ vct, 1.0 II, KtTU2F1GIJi Fd2 GsS I
.- 1 -a C iEL4 4IU CG2F'[T AL WEx— / DQ CJC6
Joll I.JC,E .
