. <br /> � <br /> of Pipeon Creek is above anadromous salmon access and therefore is of <br /> potential value primarily from a water quality paint of view to downstream salmon <br /> habitat. Although no fish have been noted in the subject reach, it would be <br /> conside+red potential trout habitat. Water quality is also deemed important from a <br /> watershed perspective from the subject site down and into Puget Sound. <br /> • A Conceptual Enhancement, Mitigation and �rotection Plan for Pigeon Creek & <br /> flssxiated Riparian Buffer(October 10, 199�) has been prepared by Randy <br /> Williams, Habitat Biologist for the Housing Hope Village Project. This plan <br /> addresses the enhancement, mitigation and protection provisions for tfiis <br /> degraded poRion of Pigeon Creek with regard to the proposed Housing Hope <br /> Villaye Development. <br /> • Prior to any development activity occuring on the proposed Housing Hope <br /> Villaqe project site the Planning Department must approve a mitigation plan for <br /> Pigeon Creek and iYs associated nparian buffer. <br /> • Pigeon Creek is classified as a Category II stream which requires a minimum 50 <br /> foot buffer on each side of the stream per the City's ESA Ordinance (37.140). <br /> There is an existing home, outbuilding, associated developed yard, and <br /> road/culvert �ossing of the creek areas that are currenty within the buffsr area <br /> which will not require mitigation for continued use. 4'lith the exception of the <br /> existing encroachm�;nts and the proposed pedestrian trail atl structures and <br /> improvements shall Ge I�cated outside the required buffer area. <br /> • Prior to the issuance of Public Works and Building Permits the Applicant must <br /> submit a II.0 Application for review and approval by the Planning Department for <br /> reducing the required 50 foot buffer area for Pigeon Creek and it's associated <br /> riparian buffer. <br /> • The Applicant shall provide a performance security bond in the amount of 300 <br /> percent of the estimated cost of implementing the enhancement, mitigation and <br /> protection plan for Pigeon Creek and iYs associa�ed nparian buffec This bond is <br /> payable to the City of Everett in order to ensure that 1) all costs for canstruction, <br /> monitoring, maintenance, and contingencies will be mst during the five (5) year I <br /> monitoring period; and 2) contingency actions, including plant replacement, can � <br /> be carried out over the five (5) year monitoring period. <br /> 17. Any work within the stream will be restricted by City stand2�ds to the period <br /> berivesn June 15 and September 15, during dry weather ornj: Seasonal <br /> limitations would also be likely as an HPA condition. The most s:�ingent <br /> limitations will apply to any stream alteration work. <br /> 18. My work done within the stream corridor should be done under the s�oervision <br /> of a fisheries biologist. Care must be taken not to destabilize the chann�al or-it's <br /> banks. In general, no vegetation should be removed along the stream ba;�ks, <br /> especially vegetation that is �roviding bank stabilization. <br /> �j 19. The 42' culvert on site under the pedestrian path across Pigeon Creek will need <br /> to be replaced. The upsizing of the culvert must be coordinated with the Public <br /> Works Department with regards to monitary responsibilities, culyert sizing and <br /> construction schedule. <br /> i <br /> 6 <br />
