For myself, my heirs, executors, administrators and assigns, Owner hereby agrees to waive, release, discharge, save harmless and indemnify (including reasonable attomey's fees and costs) the City of Everett, its officers, employees and agents from any and all liability or claims for personal or real property damage, loss or destruction, cost or expense of any kind suffered by the undersigned arising out of or resulting from the perfonnance of the Fire DepartmenYs training exercise. Provided, however, the undersigned will not be . required to hold the City, its officers, employees and agents harmless firom the sole negligence of the City, its officers, employees and agents. Further, if claims or damages are caused by or resuft from the undersigned, this indemniry provision shatl be vatid to extent of the negligence of the undersigned. 5. Owner agrees that Owner will demolish and, in the event that the trairing includes buming the structure(s), to clean up the area within 30 days following the buming of said structure(s). In case Owner fails to clAan up and/or demolish said bum area or cause it to be cleaned up and demolished at Ovmers e�ense within 30 days, Owner hereby suthorizes the City of Everett to demolish and clean up said area for which Owner agrees to reimburso the City within fifteen (15) days of bi!ling for its demolition clean up costs. 6. Owner agrees that Owner will take the following actions prior to the City's Fire Departrnent commsncing training: A. A"notification of demolition," including a$25.00 application, must be filed with the Fuget Sound Air Pollution Control Agency at least ten (10) days prior to the siart of the training acth.iity. A copy of the permit must be available for inspection at tha training site. B. An Asbestos Survey Report for Renovation/Demolition must be filed with the Puget Sound Air Pollution Control Agency prior to tho stert of the training activity. C. All composition roofing must be removed from the structure prior to the training activrty. D. All asphalt roofing shingles and asphalt siding materials must be removed from the structure prior to the training activity. E. All carpet, linoleum and floor tile materials must be removed prior to the training activity. F. All prohibited materials, including containers :�olding unknown �ubstances must be removed from the structure and site priorto the training activity. G. All utilities to the structure must be tumed off prior to the training aciivity.
