City of Everett Engineer -2- b7a;� 13, 1�82 <br />abuts shall be improved at the owner's expense in accordance <br />with specified requirements. <br />Those requirements are that business and commercial land uses <br />shall construct street and alley improvements together �aith <br />necessary appurtenances unless the City Engineer allows "interim <br />improvements as defined in the ordinance or a variance from the <br />�� <br />requirements of the ordinance. <br />The City Engineer may grant interim improvement permission where <br />he is satisfied that adequate improvements exist exc�pt for nom- <br />inal lacking of street widths or where plans for more compre- <br />hensive improvements exist �•:hich would alter the ultimate improve- <br />ments required to be con5tructed on the public right of way. <br />It is submitted that the City Engineer should find that interim <br />improvements on 75th Street ar.e sufficient for the reason that <br />adequate improvements of 75th Street now exist except for nominal <br />lacking of street widths. 75th Street was recently caidened when <br />the shoppiug cc�nter to tl'�e south was develcped and there is no <br />figure of vehicle use of 75th Street that �vould indicate it is <br />needed to be widened further at this time to acco*nmodate traffic <br />using the same. Ultimate improvements �vo11d require an additionaJ. <br />ten feet of width and curbs, gutters and sidewalks and it is our <br />understanding that such would not be constructed in the near <br />future Uy the city even though it had ownership of the land upon <br />which such construction would occur. <br />The ordinance further provides that all interim improvements <br />allowed would require a property owner to provide a power of <br />attorney in support o£ a local improvement district for construc- <br />tion of street and alley improvements together with necessary <br />appurtenances. <br />Although the applicant, Horizon �nterpri.ses, Inc., is a lessee for <br />a term of years of the s'�aject property and not the owner thereof, <br />it is willing �.o sign SL:CI1 acquiesence and covenani and can secure <br />similar signature of the otaner of the property, its landlord. <br />The ordinance zurther provides in subsection "c" thereof that all <br />owners of property shall dedicate additional rights of way as <br />necessary to complete the required street improvements in accord- <br />ance with city standards. <br />This requireraent of the ordinance cannot be met because the owner <br />of the property, the landlord, values the necessary ten feet i�o <br />be deeded to the city at approximately $15,000 as a present value, <br />
