cust u[ rcpruduction. <br />. <br />Section 16: PUULIC HGARING: 13efore renderin� a decision or recommendation on <br />any apptication, the Examiner shall hold at least one public hearing thereon. <br />Notice of the time and place of the public hearing shal! be given as provid�.d in the <br />ordinance Governing the application. If none is specifically set forth, such notice <br />shall be given at least ten (10) days prior to such hearing as fo!lows: (1) posting of <br />the property in two conspicuous places; and (2) mailing notification to property <br />owners per County Assessor records within 500 feet of ihe subject property a�id <br />identified neighborhood groups who have requested notice of land use matters. <br />Section 17: EXAMINER'S DECISION AND RECOMtiIENDATION; FINDINGS <br />REQUIRGD: \Vhen the Examiner'renders a decision or recommendation, the <br />i Examiner shall make and enter written findings and conclusions from the record <br />and condusions therefrom which support such decision. <br />\Vithin ten (10) working days of the conclusion of a hearing, unless a longer period is <br />agreed to in writing by the applicant, the Examiner shall render a written decision, <br />induding findings and conclusions, and shall transmit a copy of such decision b� <br />regular mail, postage prepaid, to the applicant and other persons who have <br />requested notice of the decision by signing a register provided at the hearing. The <br />City shall retain the right to charge a reasonable fee to recover costs associated <br />with providing such copies. The person mailing such decision shall prepare an <br />affidavit ot mailing, in standard form, and sech affidavit shall become a part of the <br />record ot such proceedings. <br />In ttie case of applicatiuns requiring Council epproval as set forth in Section 12.A.2, <br />the Gxuminer shall file a decision with the City Council at the erpiration ot the <br />fourteen (14) day period provided for a rehearing, or within five (5) days of the <br />conclusion of a rehearing, if one is conducted, provided, however, upon a finding oi <br />the existence oi unusual circumstances, the Examiner may extend said five (5) day <br />time period.
