Officials and further requested the Everett City Council to order the �: City of Everett Building Official to proceed with the work required and specified in said notice pursuant to and in accordance with said City of Everett Building Code on the grounds of the failure, neglect or � refusal of said owner(s) to comply with tkie provisions of said notice, and Whereas, the Everett City Council after examining exhibits and hearing testimony and arguments and being otherwise fully informed in the prem- ises makes the following findings: 1. That said City of Everett Building Code is a valid existing ordinance of. the City of'Everett. � 2. That the hereinabove described NOTICE OP UNSAFE SUILDING(S) was prop- erly issued and served pursuant to and in accordance with the hereinabove described City of Everett Building Code. 3. That the:City of Everett Building Official is authorized to request the Everett City Council to enter the hereinabove described order and that the Everett City Council is authorized in the exercise of its dis- cretion to so do under the provisions oi- said City of Everett Building Code. 4. That those named in said notice as the owner(s) of said unsafe build- ing(s), structure(s), or portion(s) thereof were heretofore timely noti- fied that the hereinabove described request o£ the City of Everett Build- ing Official would be presented to the Everett City Council in regular public meeting on the hereinabove mentioned date and that said owner(s) were further heretofore timely notified that the owner(s) or duly auth- orized representative(s) shall have the right to appear before and pre- sent such evidence and/or arguments to the Everett City.Council relating to the herein described matter as may be desired in said regular public meeting on said date. 5. That the building(s), structure(s), or portion(s) thereof described in said notice are unsafe and a public nuisance under the provisions of said City of Everett Building Code in the respects set forth in said notice. 6. That those named in said notice as the owner(s) of said unsafe: build- ing(s), structure(s), or portion(s) thereof have failed, neglected or refused to con�ply with the provisions of said notice in violation of pro- visions of said City of Everett Building_Code. S4hereas, the Everett City Council upon due consideration deem it desirable in the best interests of the Fublic health, safety and cvelfare that said requested order shall enter. Now, therefore, be it resolved by the City Council of the City of Everett as follows: S=ction 1. The City Attorney of the City of Everett be and hereby is authorized to initiate criminal prosecution against each of those named in tha hereinebove described NOTICE OF UNSAFL BUILDIbiG(S) as the owner(s) of the unsafe building(s), structure(s), or portion(s) thereoi: describe.d in said notice as a violator of the provisions of the City of Everett Building Code, Chapter 16.04 Everett City Code adopting and amending the Uniform Building Code 1973 Edition pi•epared by the International Confer- ence of Building Officials. Section 2.
