Vested rights are defiaed as .an eatitlement which an appllcanC <br />has to have his/her application be revieired and a project developed (if a <br />pesmit is isaued) under zoning regulatioas and procedures ezisting at one <br />moment ia time regardleas of ch�es made later and prior to final <br />completion of a project. Aay completed building pesmit application aot requiring a <br />SEPA review or aay other land use approval including, but not limited to, a <br />aubdiviaioa, ahort subdivision, binding site plan, special property use <br />permit, shoreline permit or rezoae filed prior to the effective date of this <br />ordinance which camplies *,rith the ordinancea ia effect at the time of filiag <br />and srhich results ia the issuaace of a huilding permit sha]1 be subject to <br />the zoning ordinance in effect at the date of filiag; <br />2. If a building permit applicatioa requires only a SEPA <br />review as a condition precedent and does not require any other land use <br />approval including, but not limited to, subdivisioa, ahort subdivieion, <br />binding site plan, specisl property use pezmit, shoreline pesmit or rezoae <br />and a completed SEPA applicatioa c�hich complies with all ordinances aad <br />policies in effect ae of the date ita filing hae beea filed prior to or ae <br />of the effective date of thia ordinance, it eha]1. be subject to the zoning <br />ordinaace(s) in effect at the date of filing of the SEPA application if <br />xithin ninety (90) days of the date of isauance of the threshold <br />detexmiaation or a final EIS or withia ninety (90) daya of the effective <br />date of thia ordiaaace, or in the caae of a threshold determination made <br />prior to the effective date of this Ordinance, a completed building pesmit <br />applicatioa(a) is filed �rith the City's Building Departmeat coaforming to <br />the SEPA review Which filing reaulta ia the issuance of a building pezmit <br />for a71 activity approved bq the SEPA review for that propoeal; <br />3. Aay land use applicatioa for a ehoreline substanr+A1 <br />development permit which is filed prior to the effective date of this <br />ordinance and complies Wi.th the ordinancea a�i lawe ia effect at the time of <br />filing �rhich reaults ia the issuance of a ahoreliae substaatial developmeat <br />per.mit shall be subject to the zoning ordinancea in effect at the time of <br />filing, provided a completed building permit application is filed pursuant <br />to auch approval which filiag reaulta ia the issuance of a pesmit; <br />4. Any land uae applicatioa for a rezoae whi.ch has had a <br />public hearing in zahole or in part before the City's Laad IIae Hearing <br />P.rnminar� plaaning Co�isaion or Citp Couacil prior to the effective date of <br />this ordinance ahall be proceseed in accordance wi.th the zoniag ordinancea <br />in effect at the time of auch public hearing. If the rezone is approved, <br />thie ordinance ahal.l apply to the developmeat of any property eubject to <br />such rezone unleas otherwiae specified ia the rezone; <br />5. Any variance from the City's zoning ordinaace(e) granted <br />prior to the effective date of this ordinance shall apply notvithetaading <br />the proviaiona of this ordiaaace; <br />44-02 <br />
