4. On -site detention is required; or, in lieu of providing on -site <br />detention, payment to City Drainage Fund 340 is allowed. This site <br />appears to drain in two directions with 2/3 of ''the site draining to <br />Everett Mall Way and 1/3 to 4th Avenue W, and to the south. This same <br />drainage split must be maintained after development. (Ordinance 670-80 <br />and SEPA Utilities and Public Services Policies) <br />5. Any broken or damaged sidewalk shall be repaired/replaced per the City <br />Public Works Inspector per E.M.C. Chapter 13. (SEPA <br />Transportation/Circulation Policies) <br />6. Parking must be per City Zoning Code and City Design and Construction <br />Standards. For the uses proposed, a minimum of 39 parking spaces must <br />be provided. (SEPA Transportation/Circulation Policies) <br />7. A landscape strip a minimum of 5 feet wide must be provided along the <br />entire Everett Mall Way frontage in compliance with Section 19.40.050 <br />of the Zoning Code and Section 1.13 of the Standards and Specifications <br />Manual. Plantings must consist of a minimum of 6 evergreen trees or <br />shrubs for each 20 feet in length of frontage and a minimum of 75% of <br />the area must be planted in groundcover. The trees and shrubs must be <br />a minimum of 3 feet in height at time of planting. (SEPA Aesthetics <br />and Light and Glare Policies) <br />8. A minimum of 5% of the parking area must be landscaped in compliance <br />with Section 19.40.050 of the Zoning Code and Section 1.13 of the <br />Standards and Specifications Manual. Plantings must be the same as <br />those described for the frontage landscaping in item 7 above. (SEPA <br />Light and Glare and Aesthetics Policies) <br />9. Permits must be obtained from the City of Everett Fire Department for <br />installation of the underground tanks and for the storage and <br />dispensing of Class I liquids. (SEPA Risk of Upset Policies) <br />10. A fire extinguisher a minimum size of a 2A-20BL must be located within <br />75 feet of the pumps. (SEPA Risk of Upset Policies) <br />11. All activities on the site must be in compliance with the City's Noise <br />Ordinance. This Ordinance requires that noise levels measured on the <br />residential properties across 100th St. not exceed 57 dB(A) and noise <br />levels measured on the adjacent commercial properties not exceed 60 <br />dB(A), with these figures modified as described in Ordinance 534-78. <br />(SEPA Noise Policies) <br />The lead agency for this proposal has determined that it does not have a <br />probable significant adverse impact on the environment. An Environmental <br />Impact Statement is not required under RCW 43.21C.030(2)(c). This <br />determination assumes compliance with state law and City ordinances related to <br />general environmental protection including but not limited to right-of-way <br />improvement requirements, drainage, etc. This decision was made after review <br />of a completed environmental checklist and other information oc file with the <br />lead agency. This information is available to the public on request. This <br />Determination of Non -Significance is specifically conditioned on compliance <br />with the conditions attached hereto which are incorporated by reference as if <br />fully set forth herein. <br />
