RENTAL AGREEMiENT <br />THIS AGREEM�NT, made this �25� daY ��f ��y >19�•'� between Terra Firma <br />Development f.'onipany, ?..T� ("I.aadlord") and JumP ��tart Expresso Bars, Incorporated ("Tenant"). <br />For and in cons:deration af .he rental a��d of the co�ena.rts and agreements hereinafter set forth to be <br />kept and performed by :he 1 cnant, Lar,dlord hereby rents to Teuant and Tenant rents from Landlord <br />the Premises herei�� described for the .em:, at the re�ta! and subject to an upon the terms, covenants <br />and a��ee�+-�ents herf,in��te� set �br±�. <br />1. Premises: Landl�rd hereby renls to Tenant and Tenant hereby rents from Landlord certain real <br />property in the Ci'�y of Everett, Coun!-� of Snohomish, commonly knovm as a portion of Snohomish <br />County Assessor's accour;t number 242804-1-Q�3-0007 being a portion of Lot 2, City of Everett <br />Short Plat number 23 06 and described as a trwct o� I;md 40 feet north and south along the east line, <br />60 feet M/L north and �oi�ih alofig the wes� tine, and 50 feet east and west contiguous to the <br />northerly margin of the sidewalk fronting Everett Mall Way at the, evisting curU cut. See attached <br />sketch. <br />2. Term: The premises are rented for a term of 11 months, commencing on J�me 15, 1993 and <br />month to month thereafter, unless ternunated sooner pursuant to this agreement. <br />3. Minimum Monthly Rent: Tenant shall pay rent in the amount of $350.00 per month or 5% of <br />gross sales, whichever is n.,,reater, on the fifteenth day of each calendar month to Landlord. <br />Commencing ��rith the payment of rent for the second month of occupancy and monthly thereafter, <br />Tenant shall provide Landlord with a statement showing the amount of the gross sales of the <br />previous month. The amount of gross sales in excess of $7,000.00 shall be mui:iplied by 5% and that <br />amount added to the monthly minimum rent of $350.00 paid to Landlord. Payment of rent shall be in <br />the fortn of a check made payable to Jack Cole P.ealty Corp. <br />4. Security Deposit: Concureent with Tenant's execution of this agreement, Tenant shall pay to <br />Landlord the sum of $350.00. Refund of all or a portion of the security deposit is conditioned upon <br />Tenant's compliance for timely paying rent, repair of any damage to the property, Ieavine the <br />property in a neat and clean condition, and full payment of all utilities. Within 14 days of date <br />Tenant vacates the property, the Landlord will give Tenant a full and specific statement of the basis <br />for retaining any of the above deposit, together with a check for any refund due the Tenant. <br />5. Utilities: Tenant shall be responsible for payment and connection for all utilities for the premises <br />includin� but not limited to electricity and garbage collection. <br />6. Tenant Obligations: (a.) Tenant shall keep the premises in a clean and sanitary manner. <br />(b.) Tenant shall dispose of rubbish, garba�e and waste at reasonable and regular intervals. <br />(c.) Upon termination of this agreement, Tenant sh�ll leave the premises in as good a condition as it <br />is upon esecution of this a�rzement <br />7. Sub1eC Tenant sha(I not sublet the premises nor assi�n this a�reement without the prior written <br />consent of the Landlord. <br />8. Landlord Obligations: Landlord sliall be responsible for payment of real estate ta�es and <br />assessments for the premises. <br />
