�.� Use of the Premises: Tenant shall use the premises for no other pwpose but the placing and <br />operating of a Jump Start Expresso stand for vending expresso, related beverages, and other items <br />commonly associated with Jump Start Expresso, inc. <br />Tenant agrees to conduct his business and maintain the premises in compliance with all municipal, <br />county, and state codes , statutes, ordinances, and regulations concerning the use and occupation of <br />the premises. <br />10. Insurance: Tenant shall, at Tenant's expense, procure and maintain at all times during the term of <br />this agreement a policy of comprehensive liability insurance insuring Landlord and Tenant against <br />any liability arising out of the occupancy of the premises and appurtenant areas. Such insurance shall <br />at �11 �me be in an amount of not less than $300,000.00 for injury to or death of any one p�rson in <br />one accident or occurrence and in the amount of not less than $500,000.00 for liability for property <br />damage. Tenant shall deliver to Landlord certificates of insurance evidencing the insurance amounts <br />as called for herein. <br />11. Surrender of Premises: In the event of default in the payment of rent as noted herein above or at <br />the expiration o£ this agreement, Tenant shall quit and surrender the premises to the Landlord. <br />Tenant may terminate this agreement upon H�ritten notice received by Landlord at least 20 days prior <br />to the 15th of a calendar rrionth. Landlord may tertninate this agreement upon written notice received <br />by Tenant at least 60 days prior to the 15th of a calendar month irrespective of the 1] month term <br />noted hereinabove. <br />12. Costs and Attorney Fees: If, by reason of any default or breach on the part of either party in the <br />performance of any oF the provisiqns of this agreement, a legal action is instituted, the parties agree <br />io settle the action by binding arbitration, the losing party a�ees to pay the reasonable cost of said <br />asbitration in connection therewith..lt is a�reed that this agreement shall be construed under t��e laws <br />r,f Snohomish County, State of Washington. <br />-. - <br />13. T)isclosure: Tenant is aware that Landlord is offerir.g the property for sale and that Tenant may <br />be required to surrender the premises at any time upon 60 days written notice from Landlord. <br />14.
