Borrower represents and warrants to <br /> Lender,to the best of its Imowledge after due and diligent inquiry and inspection,thal(i)no <br /> asbestos has ever bcen used in the construction,repait or maintenance of any Improvements; <br /> (ii)no Hazardous Substance is curzently being gencrated,processed, stored, transported, <br /> handled or disposed of,on, under or in the Property or any property adjoining the Property, <br /> except in accordance with all applicable laws, (iii) neither Borrower nor any other person or <br /> entity hu ever caused or pemiitted any Hazardaus Substance to be generated,processed, <br /> stored, h�ansported,handled or disposed of,on,under or in the Property, except in <br /> compliance wich all applicable laws,(iv)there is no actual or alleged violation with respect <br /> to the Property of an�fedcral,state ar local statute,ordinance,rule, regulation or other law <br /> pertaining to Hazardous Substances,(v)there is no aclion or proceeding pending before or <br /> appealable from any court,quasi judicial body or administrative agency relating to <br /> Hazardous Substances affecting or alleged to be affecting the Property,and(vi)there aze not <br /> now and never have been any underground or above-ground storage tanks on the Property. <br /> (b) S�4Yt�II1.
