<br /> Permitted Exceptions es Lender may request,and(viii)Borrower shall forever watrant and
<br /> defend the Ptoperty unto Lender against all claims and demands of any other person
<br /> whatsoever, subject only to non-delinque�it taxes and assessments and the Permitted
<br /> Exceptions. -
<br /> I.2 Non-A¢ricultural Use. The Pro�erty is not used principally for agricultural
<br /> or farming ptuposes,and Bocrower so represents and warrants to Lender.
<br /> I.3 Ha �id0us C �6ct nce5.
<br /> (a) ��P�^ntations and Wa*ranties, Bocrower represents and warranls to
<br /> Lender,to the best of its Imowledge after due and diligent inquiry and inspection,that(i)no
<br /> acbestos has ever been used in the construction,repair or maintenancc oF any Improvements;
<br /> (iiS no Hazardous Substance is currently being generated,processed,stored, transporied,
<br /> F.andled ur disposed of,on,under or in the Prope�ty or any property adjoining the Property,
<br /> except ir.accordance with all applicable laws,(iii) neither Borrower nor any other person or
<br /> entity has ever caused or petmitted any Hazardous Substance to be generated,processed,
<br /> stored,uansported,handled or disposed of,on,under or in the Property, except in
<br /> compliance with all applicable laws,(iv)there is no actuai or alleged violation with respect
<br /> to the Property of any federal,state or local statute,ordinance,cule,rcgulation or other Iaw
<br /> pertaining to Hazardous Su�stances,(v)there is no action or proceeding pending before or
<br /> appealable frnm any court, quasi judicial body or administralive agency relating to
<br /> Hazardous Substances affecting or alleged to be afTecting the Property,and(vi)there aze not
<br /> now and never have been any undcrground or above-ground storage tanks on the Pmperty.
<br /> (b) ovenant. Botrower covettants and agr�es that Hazardous Substances
<br /> will not be generated,processed, stored,transported,handled or disposed of on ihe Property
<br /> hy any person or entity,except in accordance with al]epplicable laws.
<br /> (c) pCfinitiQn. "Hazardous Substance" means petroleum,petroleum
<br /> product,natural or synthetic gas,asbestos, urea fortnaldehyde,radcm gas, polychlorinated
<br /> biphenyls, and any substances or material which may be hazardous to the health or safety of
<br /> any person,including any substance which now or hereafter becomes:egulated under any
<br /> federal, state or local statute,ordinance,rule,regulation or other!aw rels:ing to .
<br /> environmental protection,contamination or cleanup.
<br /> (d) Notification Cleanuo. Borrower shall immediately notify Lender;f
<br /> Bo�rower becomes aware of(i)any Hazazdous 5ubstance pioblem or liabi]ity with respect to
<br /> the Property, (ii)any actual or allcged violation with respect to the Property of any federal,
<br /> state or local statute,ordinance,rule,regulation or other law pertaining to Hazazdous
