<br /> Snbstances, or(iii)any lien or action with respect to any of the foregoing. Borrower shall,
<br /> at its solc expense,take all actions as may be necessary or advisable for the cleanup of
<br /> Hazardous Substances with respect to the Property, including without limitation, all
<br /> removal,containmeat �ad remedial actions in accordance with all applicable laws and in all
<br /> events in a manner sat�^fact��y to Lender,and shall further pay or cause to be paid all
<br /> cleanup,administrative and enforcement costs of govemmentai agencies if obligated to do
<br /> so by contract o�by law.
<br /> (e) �Pht of .ntrv. Lender is hereby suthorized to enter the Property,
<br /> including che interior of any structures, at reasonable times,and after reasonable notice, for
<br /> the purpose of inspecting the Property to determine Borrowe�'s compliance with this
<br /> paragraph.
<br /> I.4 Buildi e Laws.
<br /> (a) �presentations and N .r ntiea, Boaower represents and warranis to
<br /> Lenda that(i)the consWetion,repair, maintenance,and use of all Improvements comply
<br /> with all Building Laws,have been approved by all necessary govemmental authorities, and
<br /> that all certificates and pennits required for the occupa:icy and usc of the Improvements
<br /> have been obtained and are in full force and effect, (ii) there is no actual or alleged violation
<br /> of any Building Laws applicable to the Property and(iii)there is no action or proceeding
<br /> pending before o� appealable from any court,quasi judicial body or administrative agency
<br /> relating to a violation or an alleged violation of Building Laws with respect to the Property.
<br /> (h) �.pyyIIBpt. Botrower covenants and agrees that the Property will at all
<br /> times comply with all Building Laws.
<br /> (c) ��. "Building Laws"means all federal, state and local laws,
<br /> regulations, ordinances and requirements applicable to the use, development and operation
<br /> of the Property, including without limitation building,wning,plannicg,subdivision, fire,
<br /> traffic,safety,health, labor,discrimination,environmental, air quality, wetlands,shoreline
<br /> and flood plain laws, regulations and ordinanccs,the Fair Housing Act of 196R (as
<br /> amended),the Americans With Disabilities Act of 1990,and all govemmental and private
<br /> covenants,conditions and testrictions applicable to the Property.
<br /> (d) Notification: Repair. Borrower shall immediately notify Lender if
<br /> Borrower becomes awaze of any actual or alleged violation of any Building Law. Borrower
<br /> shall, at its sole expense,take all actions as may be necessary or advisable to bring the.
<br /> Property into compliance with Building Laws, including alteratians,repairs,and
<br /> replacements of any Improvements.
<br /> (e) Rieht of Fnw. Lender is hereby authorized to enter the Property,
<br /> including the interior of any structures, at reasonable times and aRer reasonable notice, for
<br /> the purpose of inspecting the Property to detetmine Boirowe�s compliance with this
