� <br /> After due consideration of the testimony and evidence presented at the public <br /> hearing, the following findings af fact and conclusions constitute the basis of the <br /> decision of the Everett Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. On June 26, 1996, the City issued an SPU Permit to Owa to "place a <br /> twelve space RV park on approximately one acre loc;ated at 10925 <br /> Evergreen Way, Everett, Washington". The approval was issued subject <br /> to seventeen conditions that were stated therein. The key language of <br /> the SPU Permit was the first paragraph in which it was stated: <br /> The City of Everett Planning Director grants approval <br /> of a request by Toshi Owa to place a twelve space <br /> recreational vehicle park on approximately one <br /> acre located at 10925 Highway 99 South (same <br /> address as the Evergreen Way address identified <br /> above). (emphasis added) <br /> Among the conditions that were imposed and are relevant to the <br /> outcome of this appeal are: <br /> (2) An electrical permit will be required if any <br /> electrical services are to be installed. <br /> (8) Landscaping must be provided per Section 35 <br /> of the Zoning Code. At a minimum this must include <br /> the following: <br /> (a)A landscape strip a minimum of five feet <br /> wide must be provided along the north, south, and <br /> west property lines except for the driveway. This <br /> area shall be planted with Type III landscaping. <br /> (b) Prior to issuance of any permits, <br /> fandscaping plans must be reviewed and approved <br /> by the Planning Department per Section 35.100 of <br /> the Zoning Code. The landscaping plan must show <br /> location and dimensions of required veqetated <br /> swales, wetponds, detention ponds, rockeries and <br /> retaining wa�ls, and grading at 2 foot intervals. <br /> Irrigation systems must be provided in all landscaped <br /> areas per Section 35.130 of the Zoning Code. A 2 <br /> year maintenance assurance device must be <br /> �� <br />
