On June 26, 1996, the City of Everett Planning Director granted approval <br /> to a request of the Appellant for a Special Property Use Permit (SPU II <br /> #1-96)for a twelve space RV park on one acre of land at 10925 <br /> Evergreen Way, Everett, Washington. The SPU was granted subject to <br /> 17 conditions. Included in the conditions was condition #16 which limited <br /> stays at the RV park to a maximum of 48 hours. (exhibit 18) On <br /> November 19, 1998, the Appellant submitted an application (expansion <br /> application)for the Special Property Use Permit. (exhibit 32) <br /> 3. The City reviewed the application of the Appellant and conducted hnro <br /> field inspections on-site. In these inspections and review, the City <br /> determined that the site was not consistent with the use that had been <br /> approved in SPU II #1-96. (exhibit 10) In the administrative <br /> determination set forth in a letter to the Appellant of April 29, 1999, the <br /> City stated in part: <br /> In summary, the City has determined that the existing <br /> use is not consistent with the previously approved <br /> SPU II #1-96, and the Ciry will not review the cuRent <br /> application for the expansion of the RV park since the <br /> current use is not functioning as an RV park and is not <br /> a permitted use in the C-t zone. As such, the existing <br /> use is illegal, and you must terminate the cuRent use. <br /> (exhibit 10) <br /> 4. Mr. Owa, in submitting the application, was provided the required forms <br /> from the City of Everett Planning Department. He completed the forms <br /> and submitted them with a filing fee. (Cross examination of Bob <br /> Landles) <br /> 5. At no time prior to the April 29, 1999, letter to Mr. Owa was he informed <br /> that the application was incomplete. (Cross examination of Bob Landles) <br /> 6. The City was unable to provide any specific ordinance supporting its <br /> position that the City is not obligated to process an application. The City <br /> did not cite a rule or regulation that allows it to refuse to process an <br /> application. (Landles testimony) <br /> 5/9 <br />
