1 <br /> . ! <br /> is not k�own by the Examiner, notice is taken that the World's Fair has <br /> been closed for many, many years. <br /> 4. The subject property was annexed within the City of Everett in 1989. As <br /> part of the annexation process, a Population Census Schedule must be <br /> drafted and filed with the City. The Population Census Schedule that <br /> was provided for the annexation that included the subject property noted <br /> the persons living on the subject property were the Appellant and three <br /> other family members. No other families or individuals are noted as <br /> living on-site. (exhibit 35, attachment "c'� <br /> 5. The subject property was annexed into the City of Everett pursuant to <br /> Ordinance 1595-89. The annexation occurred on June 21, 1989. <br /> (exhibit 35, attachment "d'� <br /> 6. The only land use permit that has been issued for the subject property is <br /> SPU II #1-96. (exhibit 16) The conditions of the peRnit have been <br /> alluded to, including condition #16, as stated abova. <br /> 7. In his letter to the City of Everett dated August 25, 1998, the Appellant <br /> stated "the RV park is new to this araa....." <br /> 8. On October 6, 1999, the Appellant submiKed a letter to the Hearing <br /> Examiner with an attachment of a County Building Permit that the <br /> Appellant contends is for a "trailer court shower building". The copy of <br /> the County Building Permit is unreadable, and it is unclear as to for what <br /> property the County Building Permit was issued and for what reason. <br /> (exhibit 36) <br /> CONCLUSIONS <br /> 1. The RV park does not yualify as a non-conforming use that is exempt <br /> from City of Everett regulation of uses or review of expansion plans. No <br /> specific use as an RV park was ever established for the subject property. <br /> Any use of the subject property for storage of recreational vehicles was <br /> temporary at the very best. The ordinance allowing such use specifically <br /> terminated 30 days after the termination of the Century 21 World's Fair in <br /> 1962. No non-conforming use continues from the use established by the <br /> Temporary Resolution. <br /> 2. At the time of annexation, the use was not an RV park. The Population <br /> Census Schedule at the time of annexation clearly established that there <br /> iq <br />
