If <br />water levels are as predicted the first year, readings may be taken semi-annually the next <br />4 years of monitoring. If water levels are not adequate, contingency measures must be <br />taken and monitoring continued quarterly. <br />Notice on Title - The property owner shall file with the Snohomish County Auditor a <br />notice approved by the Planning Department, which shall provide notice in the public <br />record of the presence of an environmentally sensitive area covenant on the property, that <br />the City's environmentally sensitive areas ordinance and MDNS requirements apply to <br />the property, and that limitations on actions in or affecting such areas exist. The applicant <br />shall produce proof that such notice has been filed for record before the City issues <br />Occupancy Permits. The notice shall nun with the land and failure to provide such notice <br />to any purchaser prior to transferring any interest in the property shall be a violation of the <br />Zoning Code (Section 37.200 of the Zoning Code). (SEPA Water and Plant and <br />Animal Policies and Seetior. 37 cf the Zoning Code) <br />The lead agency for this proposal has determined that it does not have a probable significant <br />adverse impact on the environment. An Environmental Impact Statement is not required under <br />RCW 43.21C.030(2)(c). This determination assumes compliance with State law and City <br />ordinances related to general environmental protection including but not limited to right-of-way <br />improvement requirements, drainage, etc. This decision was made after review of a completed <br />environmental checklist and other information on file with the lead agency. This information is <br />available to the public on request.
