11 <br />Ordinance No. <br />An Ordinance relating to Enforcement Procedures for City Code Violations, Amending <br />Section 4 of Ordinance No. 1383-87, as amended by Section 3 of Ordinance No. 1780- <br />91, Section 4 of Ordinance No. 2221-97 and Section 3 of Ordinance No. 2335-98 (EMC <br />1.20.040) and amending Section 6 of Ordinance No. 2221-97 as amended by Section 5 of <br />Ordinance No. 2335-98 (EMC 1.20.060) <br />Whereas, the City Council of the City of Everett has determined that a small yet <br />significant number of City of Everett property owners repeatedly fail to maintain their <br />properties free of nuisances; and <br />Whereas, the City Council of the City of Everett finds that the present ordinance relating <br />to repeat offenders fails to provide enough incentive for repeat offenders to comply with <br />the city ordinance; and <br />Whereas, the City Council of the City of Everett finds that the ownership of nuisance <br />properties is often transferred or shared between individuals or businesses; and <br />Whereas, the City Council of the City of Everett finds that often there is more than one <br />party responsible for the management of a property; and <br />Whereas, the City Council of the City of Everett finds that it is reasonable to subject <br />repeat offenders to more stringent penalties for violating the city's nuisance ordinance; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: Section 4 of Ordinance No. 1383-87, as amended by Section 3 of Ordinance <br />No. 1780-91, and Section 4 of Ordinance No. 2221-97 and Section 3 of Ordinance No. <br />2335-98 (EMC 1.20.040), which reads as follows: <br />1.20.040 Violations hearing examiner—Powers and duties. <br />A. There is created the office of violations hearing examiner. <br />B. Violations hearing examiner(s) shall be part-time and remunerated by <br />personal service contract. <br />C. Violations hearing examiner(s) shall be appointed by the mayor. <br />D. Violations hearing examiner(s) shall be licensed to practice law in the <br />state. <br />L 6 <br />
