13 <br /> After Recording Return to: <br /> Office of Housing and Community Development <br /> Snohomish County Planning and Development Services <br /> 3000 Rockefeller Avenue, M/S 304 <br /> Everett, WA 98201 <br /> SNOHOMISH COUNTY HOME CONSORTIUM <br /> INTERLOCAL COOPERATION AGREEMENT <br /> BETWEEN SNOHOMISH COUNTY AND THE CITY OF EVERETT <br /> FOR PROGRAM YEARS COMMENCING 2006 <br /> WHEREAS, the Federal Government has enacted the National Affordable <br /> Housing Act, which created the HOME Investment Partnerships Program ("HOME <br /> Program") administered by the U.S. Department of Housing and Urban Development <br /> ("HUD") through regulations at Title 24, Code of Federal Regulations, Part 92 (the <br /> "HOME Regulations"); and <br /> WHEREAS, the HOME Regulations allow units of general local government to <br /> form consortia for purposes of obtaining funds under the HOME Program; and <br /> WHEREAS, Snohomish County, a political subdivision of the State of <br /> Washington (the "County"), and the City of Everett, a municipal corporation of the <br /> State of Washington (the "City"), are geographically contiguous units of local <br /> government eligible to form a consortium under the HOME Regulations; and <br /> WHEREAS, Chapter 39.34 RCW, (the "Interlocal Cooperation Act") permits <br /> local governmental units to enter into agreements to cooperate for certain beneficial <br /> purposes if authorized to each; and <br /> WHEREAS, the County and the City have determined that forming a <br /> consortium will increase the level of HOME Program funds potentially available for <br /> use within Snohomish County, and thereby increase the combined ability of the City <br /> and the County to assist in meeting the affordable housing needs of the population; <br /> NOW, THEREFORE, the County and the City, pursuant to the Interlocal Cooperation <br /> Act and in consideration of the mutual promises and covenants hereinafter set forth, <br /> agree as follows: <br /> Section 1. Definitions <br /> a.
