13 <br /> b. Allocation of HOME funds received by the County on behalf of the Consortium <br /> shall be administered by the County. Final approval of all fund awards shall be by <br /> the County, as is required of the Representative Member. The County shall consult <br /> with the City in the planning and conduct of the solicitation and selection processes <br /> for awarding and allocating funds, including funds for Community Housing <br /> Development Organization ("CHDO") sponsored projects and for CHDO operating <br /> costs. A proportion of the available funds, calculated as follows, shall be awarded to <br /> eligible project proposals selected by the City in which the City may function as the <br /> operating entity: Of the gross amount of each annual HOME allocation by HUD to <br /> the County, 21 percent shall be allocated for eligible projects selected by the City. A <br /> portion of those funds may be used for eligible project administration costs pursuant <br /> to 24 CFR § 92.206. <br /> c. In regard to non-federal matching contributions ("match") required b24 CFR <br /> §§ 92.218 through 92.221, generally in each year the City shall assure the provision <br /> of the match required for projects of its choosing. The County shall assure the <br /> provision of the match required for all other projects. However, match in excess of <br /> the minimum requirements for either category of projects may be pooled or shared <br /> by agreement of the Members. Match credits from a program or project attributable <br /> directly and principally to the action of the County or City, respectively, shall be <br /> assigned and counted accordingly. Match credits which result from the substantially <br /> co-equal joint action of the Members, or which otherwise cannot be clearly assigned <br /> to one or the other shall be pooled and shared or separately assigned, as agreed by <br /> the Members. Any net year-end surplus match credit available to carry forward shall <br /> be attributed and utilized in the subsequent year or years in the same manner <br /> provided in this subsection. <br /> d. Any Program Income, as defined in the HOME Regulations, that is generated in a <br /> given Program Year by HOME-funded activities for which the City is the operating <br /> entity shall, at the City's option, either be applied to continuation of the same specific <br /> activity from which it is generated or be added in the following Program Year (as <br /> defined in paragraph g below) to the amount of HOME funds constituting the City's <br /> share as described in Section 3.b. above. Other Program Income received by the <br /> County shall be added in the following Program Year to the balance of funds <br /> remaining for allocation after the City's share is calculated. <br /> e. The City agrees to cooperate in providing to the County reports, documentation, <br /> and information reasonably necessary to permit the County to comply with the <br /> applicable HOME Regulations and Consolidated Plan Regulations. <br /> f. This Agreement is for the period of the federal Fiscal Years 2006, 2007 and 2008 <br /> and shall remain in effect until the HOME funds for each of those Fiscal Years are <br /> closed out as provided at 24 CFR § 92.507.
