AG'.s EMENT SETWEEN THE CITY OF EVERETT AND THE PUGET SOUND <br /> CLEAN AIR AGENCY FOR REIMBURSEMENT OF COSTS FOR USING ULTRA <br /> LOW SULFUR DIESEL FUEL AND COSTS ASSOCIATED WITH FUEL FILTER <br /> REPLACEMENT <br /> This agreement is entered into between the Puget Sound Clean Air Agency (hereinafter <br /> referred to as the "Agency"), a municipal corporation of the laws of the State of <br /> Washington, and the City of Everett, City Hall, 2930 Wetmore Ave., Everett, WA <br /> 98201-4073, (hereinafter referred to as the "City of Everett"), for the purposes and terms <br /> set forth in this agreement. <br /> Ie RECITALS <br /> W EDEAS, the Agency implements the Diesel Solutions program to reduce harmful <br /> emissions from diesel vehicles in order to improve air quality, public health, and the <br /> environment; and <br /> W! EREAS, the City of Everett operates and maintains the City of Everett's fleet of <br /> diesel vehicles and equipment; and <br /> WHEREAS, the City of Everett has committed to operate the City of Everett's <br /> vehicles and equipment on cleaner burning ultra-low sulfur diesel fuel (ULSD); and <br /> WHE',' AS, it is in the interest of the City of Everett and the Agency to reduce air <br /> quality impacts associated with vehicle and equipment operations; and <br /> WHEREAS,the Agency has discretionary grant money available from the Statewide <br /> Pollution Abatement Program which may be applied to non-school bus air pollution reduction <br /> projects; and <br /> WHEREAS,the Agency and the City of Everett agree that this grant money shall be <br /> used to pay the additional cost of purchasing ULSD and to pay additional costs caused by <br /> possible incompatibility of ULSD with the diesel vehicles or fleet fueling system through June <br /> 2006; and <br /> WHEREAS, the Board of Directors of the Puget Sound Clean Air Agency deems it <br /> desirable to enter into this Agreement with the City of Everett to provide funding for the City <br /> of Everett to purchase ULSD and to pay additional costs associated with potential fuel filter <br /> failures. <br /> IL AGREEMENT <br /> NOW, THEREFORE, the City of Everett and the Agency agree as follows: <br />
