28. Notice of the public hearing was given. There was no public testimony submitted <br />at the hearing. <br />Jurisdiction: The Hearing Exam,'ner of the City of Everett has jurisdicti�nal authority to <br />hold a hearing and to issue the decision. That authority is set forth in EMC 2.23.120. <br />Based on the above Findings of Fact, the Hearing Examiner enfers the following <br />Conclusions: <br />i:ONCLUSIONS <br />The Applicant requested approval of a Special Property Use Pernit to replace an <br />existing 67 *,00t high Snuhomish County PUD utility pole located within the City of <br />Everett's rght-of-way at 9830 Evergreen Way, Everett, Washington. The pole <br />will be replaced with a�5 foot h�gh wood pole that will have three antenna arrays <br />and two antennas per array for a total of six panel antennas attached. The six <br />panel antenres are projected to be 62.7" x 7.8" each. They will be flushed <br />mounted on ::ie utility pole. In addition, a prefabricata�_ ;:.,binet of approximately <br />52.2" x 30" will be located within a neafiy property (Shurgard property) and will <br />house radio a�,d backup Yattery systems. (finding 1) <br />2. In order for a Special Property Use �ermit to be granted within the City of <br />Everett, the General Evaluation criteria of EMC 19.41.150.0 must be satisfied. <br />These criteria have been identified in finding of fact 4. The criteria have been <br />satisfied in the manner as set foRh in findings 5-16. <br />.3. In addition to the General Evaluation criteria for Special Property Use Permits, <br />the Specific Evaluation criteria of EMC 19.41.150.D.1.c must be satisfied (see <br />finding 17). These criteria have either been addressed in the General Evaluation <br />review or in findings 18-27. <br />4. The proposal satisfies the General Evaluation criteria, as �vell as the Specific <br />Evaluation criteria. . <br />DECISION <br />Based upon the preceding Findings of Facts and Conclusions, testimony and evidence <br />submitted at ihe public hearing, and upon the impression of the Hearing Examiner at a <br />site view, it is hereby ordered that the requested Special Property Use Permit for the <br />replacement of an existing 67 foot high Snohomish County PUD utility pole in the right- <br />of-way at 9830 Evergreen Way, Everett, Washington, with a 95 foot high wood pole with <br />three antenna arrays and two antennas pei� array for a total of six panel antennas is <br />granted subject to the following conditions: <br />The Applicant shall secure all necessary permits from the City of Everett. <br />7 <br />
