Planning Commission Minutes <br />February 13, 1980 <br />Page-7- <br />FOR: 6 (Mr. Torgeson, Mr. Friel, Mr. Hummel, Mr. Simpson, Mrs. Marsh, Mr. Geniesse) <br />AGAINST: 0; ABSENT: 1 (Mike Faulkner); ABSTAIN: 0. <br />SPECIAL PROPERTY USE PERMIT #4-79 LUTHER CHILD CENTER <br />The Applicant is Luther Child Center, 4526 Federal Avenue, Everett, Wa. <br />They are proposing thb expansion of the existing Luther Child Center by construction <br />of a 13,000 square foot office and classroom space. The existing zoning is R-1 <br />Single -Family Low Density. <br />Gerry Ervine explained there was one change in the Staff Report. <br />Condition 10 has been added as follows: <br />10. The Luther Child Center must pay a sewer interceptor fee as determined <br />by the Public Works Department. <br />He also drew attention to Condition Number 9 and commented the intent is <br />the existing office space and proposed office space will be utilized for those <br />specific uses that are permitted by the Special Property Use Section of the Code. <br />Mr. Simpson brought up the controversial subi-ct of the right-of-way <br />at 44th and Federal Avenue and Gerry commented there are no specific improve- <br />ments proposed for the street at this time. The City is just attempting to <br />secure the necessary right-of-way for improvement at some point in the future. <br />Mr. Torgeson had previously asked that Staff check with the county in regards to <br />this. They weren't aware of any recent court cases dealing with acquiring <br />right-of-way. Staff also checked with theCity Attorney and they felt that the <br />acquiring of the right-of-way was permitted by our current City Ordinance. <br />Celia Strong, Public Works went into detail of the long range role of the <br />street improvement plan, and City Council's position on Ordinance 555-78. <br />Celia added that these are the minimum improvements permitted under 555-78. <br />Much discussion followed with Mr, Hummel, Mr, Torgeson and Mr. Simpson expressing <br />concerns about the reouirenerts established by Staff. <br />APPL.ICANT'S COMIMENTS <br />Mr. Henry Newton, President, Luther Child Center <br />Mr. Newton stated tonight was the first time he had heard of Conditions <br />Number 9 and 10. He didn't understand this as the facts have not changed. They <br />have no problem with Number 9. <br />He expressed a concern about signing a blank Power of Attorney. <br />They have no objection to the right-of-way along 46th, as the curve at 44th <br />' and Federal is a great speed deterrent. <br />Exhibit #4 <br />Planning Commission Minutes <br />February 13,1980 <br />0 <br />
