FINDINGS AND RECOMMENDATIONS <br />OF THE HEARING EXAMINER OF THE <br />CITY Or EVERETT <br />IN THE MATTER OF THE RECONSIDEPATION FILE NO: SPU A4-79 <br />OF A SPECIAL PROPERTY USE PERMIT <br />GRANTED TO THE LUTHER CHILD CENTER <br />RECOMMENDATION: The original Special Property Use Permit should be amended <br />to include the conditions listed. <br />INTRODUCTION <br />The.Luther Child Center, Everett, Washington, and hereinafter called Applicant, <br />requested a Special Property Use Permit from the City of Everett, Washington. <br />This request was made in 1979 and was made for the purpose of expansion of the <br />Applicant's facilities. The request was granted and the City Council of the <br />City of Everett, Washington, allowed the Special Property Use Permit at its reg- <br />ular meeting on February 27, 1980, with certain conditions to be followed. <br />The property on which the Special Property Use Permit was granted is located <br />west of Federal and north of 46th Street in Everett, Washington, and is more <br />particularly described as follows: <br />Parcel A: <br />That portion of Section 31, Township 29, N.R. 5 E.W.M., <br />Snohomish County, Washington, described as follows: <br />Beginning at the SW corner of the NW o of said section; <br />thence N 416.57 feet to a monument; thence Ely 2,624.89 <br />feet to center line of section; thence S 416.57 feet; <br />thence W to point of beginning, less street. <br />Parcel B: <br />That portion of Section 31, Township 29, N.R. 5 E.W.M., <br />Snohomish County, Washington, described as follows: <br />Beginning at the N ; corner of the section; thence S <br />on center line of section 2174.92 feet; thence W 60 feet <br />to the true point of beginning; thence continuing W 1012.99 <br />feet; thence N 207.99 feet; thence angle right 82°63'0" <br />715.30 feet; thence N to a point 881.57 feet more or less <br />N of center line of section; thence angle right 9102010" <br />271.38 feet to the W line of Federal Avenue;'thence Sly <br />g along said V line of Federal Avenue to point of beginning, <br />less and except the following described tract: <br />Beginning at the SF, corner of the NW ; of said section; <br />thence Nly along the E line of said NW 4 941.57 feet; <br />thence angle left 90°2310" 417.86 feet; 8hence angle left <br />89 40'0" 150 feet; thence angle right 89 4010" 411.89 feet <br />thence angle left 8904010" 121 feet; thencS angle right <br />89 40'0" 243.24 feet; thence angle left 89 4010" 46.01 feet <br />to the true point of beginning; thence angle left 9703710" <br />343.02 feet; thence angle right 97 3710" 150 feet; thence <br />angle right 89040' 340 feet; thence angle right 90°20'0" <br />106.51 feet to the true point of beginning. <br />The above described land is zoned R-1, Single -Family Low Density, as established <br />in the City of Everett Zoning Code. <br />The Applicant constructed additional facilities on the above described property <br />using the authority granted to them in a Special Property Use Permit. The City <br />of Everett Planning Department has determined that there are violations of the <br />condition:: listed in this Special Property Use Permit and has applied to the <br />Hearing Examinr_r for a reconsideration of the Special Property Use Permit and <br />additional conditions tc be applied thereto. <br />-1- <br />
