Findings and Recommendations of the <br />Hearing Examiner of the City of Everett <br />Luther 3 Child Center SPU #4-79 <br />Page <br />other amenities to the structure. <br />5. it is the position of the City of Everett- Planning Department that the <br />Applicant has deviated from the conditions listed in the Special Use Per- <br />mit for the subject property and that this deviation has resulted in un- <br />approved changes from the original site plan and the original approved <br />project. <br />6. In particular, the Planning Department testified that the Applicant deviat- <br />ed from Condition-#6 of -the original Special Property Use Permit. Con- <br />dition 46 of the Special Property Use Permit is as follows: <br />All site improvements, including, landscaping, shall conform <br />with the site plan submitted on October 10, 1979, or be sub- <br />ject to additional Planning Commission and City Council review. <br />The Planning Department of the City of Everett, Washington, contends that <br />the deviation from Condition #6 of the original Special Property Use Permit <br />included the following: <br />A. The original approval required that 68 off-street parking spaces be <br />provided. (The Applicant is currently proposing 44 spaces.) <br />B. The original plans called for the structure to be located approximately <br />45 feet north of its actual"location. <br />C. The original building design was modified to allow the addition of <br />approximately 10 feet to the west end of the building. <br />D. The roof line of the structure was modified after plans were submitted <br />to the Planning Commission and City Council. The initial plans called <br />for a 6 foot depression in the roofline over the main entrance. This <br />feature would have reduced the visual impact of the proposed 150 foot <br />long structure on surrounding residential properties. <br />7. It is the Planning Department's position that the reduction in the parking <br />spaces, the relocation of the structure, the elongation of the structure, <br />and the changes in the roofline reduced the compatibility of the project <br />with the surrounding neighborhood. <br />8.. In order to correct the deviations from the original Special Property Use <br />Permit, the Planning Department of the City of Everett, Washington, has <br />recommended the approval of the Special Property Use Permit reconsidera- <br />tion with the following conditions being imposed to create greater neigh- <br />borhood compatibility: <br />l. andtParkslDepartmentsplans be provideto ad showing substantial landscapingoonythe ePlanning <br />the south <br />and east sides of the structure to reduce the visual impact of the <br />structure on the surrounding residential properties. There shall be <br />at.d.minimum 15'evergreen trees 10 feet in height planted around the <br />main south entrance to the facility'. An additional 25 trees 10 feet <br />In height shall be planted along the edges with exposuie to the resi- <br />dential areas, <br />2. That the number of parking spaces and the design of the parking lot <br />is acceptable to the Transporation Engineer. <br />3. Additional improvements: Raised lip around the catch basins and the <br />eastern edge of road. <br />9. The Applicant testified that because of financial restraints it was forced <br />to abandon some of the original designs as submitted to the City of Everett, <br />and, was forced to relocate some of the structures that were constructed. <br />It is the position of the Applicant, however, that the City had constructive <br />notice of these changes in that the Applicant did submit the plans to the <br />City prior to construction. <br />-3- <br />
