I. <br />75 <br />Iebruary 18, 1981 <br />11,u1.1 was called with all Councilmen voti!ig yes, except Councilman <br />Michelson, who voted no. <br />notion Carried <br />PUBLIC HEIARING - SIIRCTnL PROPERTY USE PERMIT RECONS'CDERITION (CP. 812-57) <br />Ge,-ry r•.rvine said this was a public hearing to reconsider a special <br />property use permit to the Luther Child Center at 4526 Federal nv,enue. <br />On February 27th, tIe Council. had granted the permit for a spe(:i.f'c <br />site plan and t:7ith cort-ain conditions. The building, as construci:ed, <br />does not conform with the approved si.'.: plan and the: cond:_tions placed. <br />The areas of non-conformance are as follows: <br />1. The original a,)i.)roval required that 68 of`-stroet parking spaces <br />be provided. The applicant is currently proposing 47 spaces. <br />2. The original plans called for the structure to be located approxi- <br />nately 45 feet north of its actual. location. <br />3. The original building design was modified to allow an addition <br />of: approri.matel.y ten feet to the west end of: the building. <br />4. The roofl.ine of the structure was modified from that shown <br />in the approved site plan. The initial plans called for a �Jx <br />foot depression in the r.00fl.i.ne over the main entrance. Th`., <br />feature would have reduced the visual impact of the 150 fo:,.. <br />long structure on surrounding residential properties. <br />iie said this permit is coming back, to i_l:e Council for reconsideration <br />because of the above violations of the or.ig�.•:•1-special property use <br />permit. <br />Councilman Gipson asked for some explanation as to why this problem <br />had arisen and Mr. Ervine said there seemed to be a lack of communi- <br />cation between the Planning Department and the Building Department. <br />This was being corrected and a copy of all plans and permits of this <br />nature approved ijy the Planning Department were being sent to the <br />Building Departr,,2nt for their records. <br />President Baker asked if anyone in the audience wished to speak and <br />Dixon Dahl, of 44,11 Federal., said in the original findings of the <br />Council they said this building would not have an :impact- on the <br />neighborhood, but it definitely does have an impact-. He urged the <br />Council to insist: that the landscaping be implemented as Planni.ncr <br />Department recommends. Ile evas not against the property use permit <br />as he had been in on all the hearings and felt that it was going to <br />be a good structure.
