February 18, 1981 0 <br />A <br />was called with all Councilmrti voting yes, except Councilman <br />m1chelson, who voted no. <br />Motion Carried <br />PUBLIC HEARING - SPECIAL PROPERTY IISI3 PiiRMIT RECONSIDERATION (CP• 812-57) <br />Gerry Ervine said this was a public hearing to reconsider a speci;il <br />property use permit to the IAlthen' Child Center at 4526 Federal Av,,:nuc. <br />on February 27th, the Council had granted the permit for a specific <br />site plan and with certain conditions. The building, as consLructod, <br />does not conform with the approved si.'., plan and the conditions placed. <br />The areas of non-conformance at.-e as foilows: <br />1. Tile original approval required that 68 off-street parking spaces <br />be provided. The applicant is currently proposing 47 spaces. <br />2. The original plans called for the structure to be located approxi- <br />mately 45 feet north of its actual location. <br />3. The original building design was modified to allow an addition <br />of: approxi.mat-el.y teii feet to the west end of: the building. <br />4. The roofline of: the structure was modifi.ed from that shown <br />in the approved site plan. The initial plans called for a !.ix <br />foci depression in the roofl.i.ne over the main entrance. Thy.:; <br />feature would have reduced the visual impact- of the 150 foe,;. <br />long structure on surrounding resid.ontial. properties. <br />yr• said this permit is coming back to the Council for reconsideration <br />hecause of the above violations of. the original special property use <br />permit. <br />Councilman Gipson asked for some explanation as to why this problem <br />had arisen and Mr. Ervine said there seemed to be a lack of communi- <br />cation between tine Planning Department and the Building Department. <br />This was being corrected and a copy of all plans and permits of this <br />nature approved by tine Planning Department were being sent to the <br />Building Depar.tmant for their records. <br />President Baker asked if anyone in the audience wished to speak and <br />Dixon Dahl, of 44,11 Federal., said in the original. findings of: the <br />Council they said this building would net have an impact- on tile <br />ueighbor1naod, but it definitely does have an impact. He urged the <br />Council. to insist that the landscaping be implemented as Pl.anni.nq <br />Department recommends. Ile *,ras not against the property use permit <br />as he had been in on all the hearings and felt that it was going to <br />be a good structure. Hocaever., it had been changed and definitely <br />needed much more landscaping. <br />Henry Newton, Immediate•past-president- o.f:.the Luther Child Center, <br />said they were fully in agi:eemcnL- with tine Hearing Examiner's <br />findings and conclusions and were ready to implement- them. <br />Pres-dent Baker asked if there was anyone further who wished to <br />speak. and no one replied. <br />Moved by Councilman Langus, seconded by Councilman Pope, that tine <br />public heari.nq be closed. <br />Roll was called with all Councilmen voting yes. <br />motion Carried <br />
