February 18, 1981 <br />0 <br />,ll was called with all Councilmen voting yes, except- Councilman <br />hiichelsoll, who voted no. <br />Notion Carried <br />PUBi1:C HEARING - SPECIAL PROPERTY IISI; pi-;rZI417' ,2FICONS'IDERATION (CB 812-97) <br />Gerry Ervine said this was a public hearing to reconsider a special <br />property use permit: to the Luther Child Center. at 4526 Federal A%-�nue. <br />on Febr.uaxy 27th, the Council. had granted the permit for a speci.f;c <br />Bite plan and �=it-h certain conditions. The bui-ldi.ng, as constructed, <br />dreg not conform with the approved si.'.- plan and the conditions placed. <br />The areas of non-conformance are as follows: <br />1. The original approval required that 68 off-street parking spaces <br />be provided. The applicant is currently proposing 47 spaces. <br />2. The original plans called for the structure to be located approxi- <br />mately 45 feet north of its actual location. <br />3. The original building design was modified to allow an addition <br />of approximately tell feet to the west end of: the building. <br />4. The roofline of the structure was modified from that shown <br />in the approved site plan. The initial plans called for it ,ix <br />foot depression in the roofl.i.ne over the main entrance. Thy. <br />feature would have reduced the visual impact of the 150 fo: <br />long structure on surrounding r.esi_(Icnitial properties. <br />Ii.. said this per is coming back to the Council. for. reconsidel:ation <br />because of the above violations of the original special property use <br />Permit. <br />Councilman Gipson asked for some explanation as to why this problem <br />had arisen and Mr. Ervine said there seemed to be a lack of communi- <br />cation between the Planning Department and the Building Department. <br />This was being corrected and a copy of all plans and permits of this <br />nature approved by the Planning Department were being sent to the <br />Building Department for their records. <br />President Baker asked if anyone in the audience wished to speak and <br />Dixon Dahl, of 44,11 Federal., said in the original findings of the <br />Council they said this bui.idinq would not have <<.ill impact- on the <br />neighbori:ood, but it definitely does have an impact. tie urged the <br />Council. to insist that the landscaping be implemented as planning <br />Department recommends. I4e%s;as not against the property use permit <br />as he had been in on all the hearings and felt that it was going to <br />be a good structure. However., it had been changed and definitely <br />needed much more landscaping. <br />Henry Newton, Immediate Past --President of .the Luther Child Center, <br />said they were f.u11y in agreement with the Hearing Examiner's <br />findings and conclusions and were ready to implement- them. <br />President- Bakcr asked if: there was anyone further who wished to <br />speal, and no one replied. <br />Moved by Councilman Langus, seconded by Councilman Pope, that the <br />public hearing be closed. <br />Roll was called with all Councilmen voting yes. <br />Motion Carried <br />,r <br />
