J <br />W <br />L <br />Luther Child Center <br />Special Property Use Permit 7-84 <br />Page -9- <br />8. The Everett Planning Department has recommended approval <br />of the conversion and the Special Property Use Permit <br />subject to the conditions listed in Finding #13. <br />9. It has not been shown that the proposed conversion of <br />the existing use of the subject property into a <br />pediatric and diagnostic treatment clinic will <br />necessitate a dedication of additional right-of-way on <br />the northeast corner of the Luther Child Center <br />property. The proposed conversion will not generate <br />additional traffic on Federal Avenue. No expansion of <br />the facility is envisioned. <br />10. Dedication of right-of-way at the southeast corner of <br />the Luther Child Center property as a condition of <br />approval of the Special Property Use Permit is <br />reasonable. At this area, Federal Avenue and 46th <br />Street S.E. intersect. This will be the main access <br />point to the proposed clinic. Improvement of the <br />right-of-way at this area is required. <br />11. Testimony in support of the Special Property Use Permit <br />has been noted above. <br />DECISION <br />Based upon the preceding Findings of Facts and Conclusions, the <br />testimony and evidence submitted at the public hearing, and <br />upon the impressions of the Everett Hearing Examiner of <br />he <br />site view, it is hereby ordered that the Special Property Use <br />Permit as requested by the Applicant to allow the conversion of <br />one existing 4,400 square foot building at the Luther Child <br />Center to be used as a pediatric and diagnostic treatment <br />clinic for Providence Hospital is granted. The Special <br />Property Use Permit is granted subject to the following <br />conditions: <br />1. The Applicant is to dedicate property south of the <br />proposed north right-of-way line on 46th Avenue S.E. for <br />public right-of-way. The right-of-way line is to be <br />42.5 feet north of Blocks #1 and #2 of the plat of <br />College Hill Addition. <br />2. The Applicant is to dedicate additional right-of-way on <br />the southeast corner of the Luther Child Center property <br />for right-of-way purposes. This right-of-way is to be <br />used for the improvement for the intersection of 46th <br />Street S.E. and Federal Avenue. <br />I <br />1 <br />
