ALSO, all that portion of Tract <br />Addition, described as follows: <br />13 of said Monson <br />Beginning at the Southwest corner of said Tract 13, the <br />True Point of Beginning; thence North 160 36' 30" East <br />along the West line of said Tract 13 a distance of <br />130.61 feet; thence South 280 03' 30" East a distance <br />of 45.85 feet; thence South 340 48' 36" West a <br />distance of 103.16 feet to the True Point of Beginning. <br />All situated in the County of Snohomish, State of <br />Washington. <br />And, Whereas, after proper notice was given as required by law, a <br />I <br />'public hearing was held on March 1, 1984, before the City of Everett Land Use ; <br />Hearing Examiner, and <br />u <br />I <br />Whereas, after consideration of the evidence presented by the I <br />Applicant; evidence elicited during the public hearing; and as a result of a <br />personal inspection of the subject property and surrounding areas; the Hearing <br />Examiner made findings and conclusions and rendered a decision on April 2, <br />1984, to grant the Special Property Use Permit with the following 37 <br />conditions: <br />1. All requirements contained in Title 17 of the Everett Municipal Code <br />shall be met unless identified in Exhibit #7 as modified February 23, <br />1984. <br />'2. Development of the property be in accordance with the concept presented <br />in the Site Development Plan dated January 24, 1984 (Exhibit #4) as <br />modified by this report. <br />I <br />�3. Where the subject property is adjacent to existing residential uses <br />that are within ten feet of the same grade, the Applicants shall <br />maintain existing vegetation in a manner to create a sight -obscuring <br />barrier, supplement the existing vegetation to attain this goal or <br />plant a five foot wide, six foot high sight -obscuring barrier. <br />Adjacent to the .Fleming Street frontage ornamental plantings to a <br />minimum width of six feet shall be maintained. A specific planting '. <br />plan shall be developed for perimeter treatment, steep slope areas and <br />common areas within the subject property by a landscape architect. A <br />cost estimate for the above improvements shall be provided. A bond <br />will be required of the applicant to insure that the above -mentioned <br />improvements are properly installed and maintained. <br />4. The Applicants shall submit landscape standards to the City for review <br />and approval which establish the minimum improvements permitted on <br />individual lots within the park. Specific landscape standards for the <br />individual lots shall be submitted with the site development plan. <br />5. Unless otherwise agreed by the Department of Public Works, all roof <br />drains shall be tightlined to the proposed storm drainage system. The <br />Department of Public Works and the Applicants are encouraged to <br />consider other types of drainage on site. <br />-5- <br />
