RESOLUT:.ON (CB773-96) Moved by Councilman Moore, seconded by Councilman Langus to adopt Resol- uti.on No. 1267 as follows: A'nereas �n the 30th day of bfarch, 1977 the City of Everett Building Official or his duly authorized representative requested the Everett City Council in regular public meetinq to order that those named in that cer- tain NOTICE OP UNSAFE IIUILDING (S) dated the 15th day of July, 1976 (Unsafe Buildings Reference No. 7607-212) , a duplicate original copy of which is attached hereto and by this reference incorporated herein as though set forth in full herein, as the owner (s) of the unsafe building (s) or structure (s) or portion (s) thereof described in said notice prosecuted as a violator of the provisions of the City of Everett Building Code, Chapter 16. 04 Everett City Code adopting and amending the Uniform Building Code, 1973 Edition prepared by the International Conference of Building Officials and further requested the Everett City Council to order the City of �verett Building Official to proceed with the work required and specified in said notice pursuant to and in accord3nce with said City of Everett Building ,Code on the grounds of the failure, neglect or refu- sal of said owner (s) to comply with the provisions of said notice, and Whereas the �verett City Council after eYamining exhibits and hearing testimony and arguments and being otherwise fully info.rmed in the prem- ises makes the following findings : 1. That said City of Everett IIuilding �ode is a valid existing ordinance of the City of Everett. 2. That the hereinabove described NOTICE OP UNSAFE BUILDING (S} wUs pro; - erly issued and served pursuant to and in accordance with the hc:reinabove described City of Everett Building Code. , 3 . That the City of Everett IIuilding Official is authorized to request the Everett City Council to enter the hereinabove described order and that the Everett City Council is authorized in the exercise of its dis- cretion to so do under the provisions of said City of Everett Building Code. 4 . That those named in said notice as the owner (s) of said unsafe build- ing (s) , structure (s) , or portion (s) thereof were heretofore timely noti- fied that the hereinabove described request of the City of Everett Build- ing Official would be presented to the L;verett City Council in regular public meeting on the hereinabove mentioned date and that said ocaner (s) were further heretofore timely notified that the o�vner (s) or duly auth- orized representative (s) shall have the right to appear before and pre- sent such evidence and/or arguments to the Everett City Council relating to the herein described �matter as may be desired in said regular public meeting on said date. 5.
