Spescek and Janet L, Spesock were duly notifiod via personal delivery of these <br /> conditions on Dccember 13, 1999,were given the oppornmily to coaect iltese conditions, and <br /> have hnd adequate notice of the opportunity to appwr at the hearing to appeal the City's <br /> allegations. <br /> 7. The City has provided input on the immediate correction of the sto:m drainage. <br /> Conclusions of Law <br /> 1. The conditions as described above constitute violations of Everett Municipal Code 5ections <br /> 14.28.030 and Section 19.39.150(C). <br /> 2. The property owners to dato ha�•e not cocrected said violations. <br /> 3. Pursuant to Chapter 1.20 of ihe Everett Municipal Code, the Violations Hearing Exatniner has <br /> jurisdiction over this matter and partics. <br /> ORAER <br /> Based oa the Findings of Fact and C onclusions of Law read into the reeord at tha December 16, 1999 hearing of <br /> the above matter,the following Order is issued: <br /> 1. Jeffrey C. Spesock and Janet L. Spesock ("Owners") shall immediately establish with the building <br /> department of the City of E�erett an approved method to c"c'- -" -�''"'�^.^.s of Everott Iv7unicipal Code <br /> 5ections 14.28.030 end 1939.150(C) on the property located at 4724 Gardner Avenue, Everett, <br /> Washingtoi�. Owners must also enter into a written agreement with tha building depattment as to the <br /> timing o£the remedial aetion. <br /> 2. Owners shall be fined 5500.00 for said violations. Of this 5500.00 fine, all will be suspended upon <br /> cempliance with the£ollowing condirions: <br /> a. Owners shall abate all violations of Evereri Municipal Code SecHons 14.28.030 and <br /> 19.39.1.50(C). <br /> b. Owners shall not violate any or3inance set forth in�MC 1.20.020 or any ordinance or regulation <br /> that identifies the enforcement procedure described in Chapter 1.20 HMC as the enforcement <br /> procedure for said regulations or oidinance,for tho next twelve(12)months. <br /> c. Owners shall make immediate conteet with the building depaztment of the City of Everett to <br /> establish an approved method to abate the violations on lhe propeny. <br /> �3 <br />
