Spesock ) <br /> 472A Gardner Avenue ) <br /> £verett,WA 98203 ) <br /> Appellants. ) <br /> Thia tnatter having come before the Violations Heazing Examiner on Decembee 16, 1999,and the testimony of <br /> witnesses having becn heard and all exhibits admitted into evidence having been considercd, the Violations <br /> Hcazing Examiner makes the following findings of fact and conclusions of law and order: <br /> Findings of Fact: <br /> 1. On December 3, 1999,Marian G.Dent,code compliance officer and housing inspator for the <br /> City of E� .rett,obse�ved the foll�wing conditions on the property at 4724 Gardner Avcnue, a <br /> parcel less than one acre,Everett Washington:Ecology blocks were placed on three sides of the <br /> rear property lines,put in place to be used for a retaining wall. Arainage had become a problem <br /> azound the perimeter of the reu yard causing silt and wata to drain onto adjoinirtg pmpe[ty and <br /> cause damage to the adjoining prope�ties. The ecology blocks are 77 inches high in some <br /> locations and are holding back soil which is piled high above this height. The blocks bow and <br /> lean away&om the soil they have been placed to hold back. <br /> 2. The City of Everen building department has issued a Stop Work Order regazding the above <br /> conditions. <br /> 3. On December 2, 1999 the City of�verett$uilding Of�ficial and two associate engineers sent a <br /> letter to Mr. Spesock advising him that the height of the wall cannot exceed 36"within tlte rear <br /> yard setback and the surface water drainage from the property onlo adjacent prope[ty cannot be <br /> altered or concentrated to create a point discharge. The letter requested contact by Aecember 9, <br /> ]999 to establish an appro�•�d method to fix the non-compliant items and a commitment as to the <br /> timing of the remedial action. <br /> � <br />
