Blue Bay Inc. <br /> Appeal <br /> Page -3- <br /> 3 . On March 10, 1988 , the Appellant filed an appeal of this <br /> determinalion. (exhibi.ts 5 & 10) <br /> 4 . The subject property is zoned R-2. The properties <br /> surrounding the subject property are also zc�ed R-2 and <br /> are developed with single family residences . (staff <br /> reporl) <br /> 5 . The Everett Municipal Code (EMC) 19.16.030 establishes <br /> minimum lct size and width sttindards . That section <br /> r=ads: <br /> No lot shall be less than five thousand <br /> square feet in area for a single-family <br /> dwelling nor less than seven thousand <br /> • five hundred square Eeet in area for a <br /> two-family dwelling (duplex) . A lot <br /> width of fifty feet or more shall be <br /> provided for any permitted residential <br /> use. EXCEPTION: Where a lot has less <br /> area than herein requiced as shown by <br /> the conveyance of record at the time of <br /> the passage of this chapter (December 1, <br /> 1956) , this regulation shall not <br /> prohibit one private dwelling and its <br /> accessocy building on such lot, provided <br /> all yard requirements of this section <br /> are complied with. (staff report) <br /> 6 . EMC 19.16.030 provides an exception to the lot standards <br /> for R-2 zoned property. If a lot can be documented as <br /> non-conforming by review of conveyances of record at �:he <br /> time of the establishment of the Zoning Code (December <br /> 1 , 1956) , standards less than required by EMC 19 . 16 .030 <br /> are allowed. The City will consider deeds, real estate <br /> contracts and other documents in its review to determine <br /> if an exception exists . (staff report and Anderson <br /> testimony) <br /> 7 . The City contended that lots 9 and 10 of Block 34 , Pla+_ <br /> of Pinehurst Division "B" , were held in ownership with <br /> the subject property, lols 11 and 12, at the time of rhe <br /> passage of the Everett Zoning Code on December 1, 1956, <br /> and thus are considered one parcel of property. <br /> 8 . The City submitted that lots 11 and 12 contain a tolal <br /> of 4,060 square feet and do not meet the minimum lot <br /> size requirements for R-2 zoned property. These lots , <br /> togelher with lots 9 an 10 , contain 8, 120 square feek <br /> and it is the City's position that the square Eootage of <br /> the four lots satisfies minimum zoning requirements for <br /> one lot in the R-2 zone .
