The City submitted that they will not certify lots 11 and 12 as non-conforming lots and thus a building permit cannot be issued because these loks are considered a part of a larger parcel based on the conveya�ice of record as of December 1. 1956 . (Anderson testimony, staff report) 10 . The conveyances of record of lots 9. 10. 11 and 12 of the Block 34, Plat of Pinehurst Division "H" , are as follows: A. The lots were created as part of the Pine Grove Land Plat in 1909. B. In 1911, lots 9, 10, 11 and 12 were conveyed from • the Pine Grove Land Company to Anwick . C. A house was built over the lot line of lots 9 and � 10 in 1920 by Anwick. D. In 1954, lots 9. 10, 11, and 12 and 24 of Division "B" were part of a probate. An order setting aside these lots in order of lieu of homestead was issued by the courts . E. On December 1, 1956 , the City of Everett adopted �he Everett 2oning Code. (Allendoerfer testimony) 11 . Since the Everetc Zoning Code has ,been adopted, the following conveyances of the subject property have occurred: � A. In 1966 , Anwick deeded the property to Severson . B. in 1970, the Severson estate deeded the propecty to Bogart. C. In 1980, Bogart deeded the property to Robinerr . D. In 1987, Robinett deeded the property to Blue Bay , Inc. (Allendoerfec testimony) 12. The Appellant contended that the City's interpretation of lots 9 , 10, 11 and 12 being considered as one parcel is a merger of the Eour lots .
