The City submitted that they will not certify lots 11 <br /> and 12 as non-conforming lots and thus a building permit <br /> cannot be issued because these loks are considered a <br /> part of a larger parcel based on the conveya�ice of <br /> record as of December 1. 1956 . (Anderson testimony, <br /> staff report) <br /> 10 . The conveyances of record of lots 9. 10. 11 and 12 of <br /> the Block 34, Plat of Pinehurst Division "H" , are as <br /> follows: <br /> A. The lots were created as part of the Pine Grove <br /> Land Plat in 1909. <br /> B. In 1911, lots 9, 10, 11 and 12 were conveyed from <br /> • the Pine Grove Land Company to Anwick . <br /> C. A house was built over the lot line of lots 9 and � <br /> 10 in 1920 by Anwick. <br /> D. In 1954, lots 9. 10, 11, and 12 and 24 of Division <br /> "B" were part of a probate. An order setting <br /> aside these lots in order of lieu of homestead was <br /> issued by the courts . <br /> E. On December 1, 1956 , the City of Everett adopted <br /> �he Everett 2oning Code. (Allendoerfer testimony) <br /> 11 . Since the Everetc Zoning Code has ,been adopted, the <br /> following conveyances of the subject property have <br /> occurred: � <br /> A. In 1966 , Anwick deeded the property to Severson . <br /> B. in 1970, the Severson estate deeded the propecty <br /> to Bogart. <br /> C. In 1980, Bogart deeded the property to Robinerr . <br /> D. In 1987, Robinett deeded the property to Blue Bay , <br /> Inc. (Allendoerfec testimony) <br /> 12. The Appellant contended that the City's interpretation <br /> of lots 9 , 10, 11 and 12 being considered as one parcel <br /> is a merger of the Eour lots . The Appellant claimed <br /> that the City has no authority for a merger of these <br /> lots because the ordinances of lhe City of Everett are <br /> silent on this subjecl .
