City Atto•ney 's Office
MEMORANDUM
TO: Tim Tyler, Building Ofticial
FROM: Laura Van Slyck, Assistant City Attorney
DAI'E: February 16, 2000
SUBJECT: City of Everett v. Diane French
5718 Commercial Avenue
Diane French is the owner of property located at 5718 Commercial Avenue. She has had
a detached garage built on her property. The garage was built in a manner that does not
comply with the plans that were approved. I'm not sure about all of the technical details,
but one aspect ofthe noncompliance with the plans seems to be that rhe plans showed a
flat lot, and the garage as built is not on a Flat lot. The permit was issued 10/17/97
(#856787).
In January of 1998 the neighbor to the north ofMs. French's property, John Ritchie (sp?),
complained that the garage is over the allowable Zl feet in that zone. On February 3,
1998 Steve Ingalsbe and Jeff Heilman went to the site to check the height of the garage.
They found that the garage was approximately 22 inches over the maximum height. The
contractor was notified that he should not continue working and that the owners should
be notified. The trusses were in place on top of the walls, but no roof sheathing had been
installed on either roof. The contractor was told that the lover roof would be within the
allowable height restriction, but the upper roof would have to be lowered. The contractor
was told that the Ms. French would have to submit revised drawings to show compliance
with the zonin code.
On February 12, 1998 Jeff Hcilman sent a letter to b1s. French advising her that the
garage as built appeared to not comply with the approved plan and appeared to exceed
the allovable height of detached accessory buildings. He stated that the letter would
serve as a Stop Work Order as set forth by the State Building Code and told her she
would need to contact either [ngalsbe or Heilman to discuss the options for resolution.
In June of 1998 you and Heilman went to the site and noted that the garage appeared to
be finished. On June 16, 1993 you sent a memorandum to Michael Weight, City
L
