Prosecutor, and to me as Code Compliance Director, requesting assistance. The case was <br /> assigned to Mike Weight for follow-up and enforcement. <br /> On July l, 1998 Mike Weiglu met with you, Gerry Ervine, Ingalsbe and Heilman. <br /> Apparently Ms. French had misrepresented the maximum height of the garage. The <br /> limitation under the zoning code is 21 feet. The stop work urder was not posted at the <br /> property, and was sent regular mail. Heilman verbally informed the contractor to stop <br /> work. <br /> On August 17, 1998 Mike Weight sent Ms. French a letter stating that the garage is not in <br /> compliance with the Building Code and constitutes a nuiaance. He advised her that <br /> Violation of the Building Code is a misdemeanor and that if she failed to contact you by <br /> August 26, 1998, his oflice mioht file a criminal charge. <br /> On that same day, Mike Weight spoke with Ritchie. Ritchie was concerned about water <br /> runoff and the tocation of the garage vis-a-vis the property line between his property and <br /> French's property. Weight said he would talk with you about it. His file notes indicate <br /> that he and you spoke about it and that you would call Ritchie. Apparently you did so on <br /> August 18, 1998. <br /> On September l, 1998 Ms. French sent you a letter, cc Weight. She said that the garage <br /> was completed on 2/7/98 and that the contractor had been paid in full and the check <br /> cashed. She wanted to know why she hadn't heard of any height problem p�ior to <br /> completion of the garage. She said that the contractor(George Durrin) ha;l talked with <br /> Heilman and Ingalsbe before starting the project to see if there was anything he needed to <br /> be aware of other than what was on the approved plan. <br /> On September 22, 1998, yo��, Ingalsbe and Heilman met with French on-site. She <br /> explained that she had paid the contractor and that she knew nothing about a stop work <br /> order. She said she is out of money and hasn't finished the retaining wall to the north or <br /> the grading that she and the property owner to the north agreed upon. On November 3, <br /> 1998 you briefed Weight about your 9/22 meeting with French. You stated that she had <br /> dug a temporary ditch to deal with the drainage problems. <br /> On December 23, 1998 you sent a letter ro French advising her that the garage was <br /> constructed contrary to the approved plans relative to height and that it curcently <br /> measures 23 feet. You stated that in order to avoid further action to resolve the matter, <br /> she would need to provide evidence of height measurement that is within the 21 feet <br /> allowed by code by January 29, 1999. <br /> On December 23, 1998 Weight rold Ritchie that we were giving French an opportunity to <br /> get an additional height measurement and that we would file criminal charges if the <br /> matter weren't successfully resolved. �'l'eight told Ritchie that the City doesn't usually <br /> get involved with property line disputes. <br /> z/y <br />
