5. The residen�e was constructed long before the Applicants purchased it in 2005. <br /> (testimony of Lisa Bemrose) A Certificate of Occupancy was issued for the <br /> subject properly on June 10, 1980. The original site plan indicated that the <br /> structure satisfied the then required 20-foot front selback and five-foot side <br /> setback of the R-1 zone. The subject properiy rerriains zoned R-1, but the <br /> setback standards have changed. (exhibit 1, staff report) <br /> 6. The subject property is a long and narrow wedge shaped lot that is approximately <br /> 11,180 square feet in area. Much of the property is highlighted by a steep sloped <br /> area that includes vegetation with a significanl number of large evergreen lrees. <br /> A residence is developed on the northeast corner of the lot near the base of lhe <br /> slope. The slopes are a limiting element of the property and in places are in <br /> excess of sixty-five percent. (exhibit 1, sta/f report) <br /> 7. A retaining wall at ihe toe of the slope was conslructed south of the residence. <br /> The reiaining wall is now failing and is compromising the support system of stairs <br /> and the deck of the residence. The Applicants consulted lhe Jason Engineering <br /> and Consulting Business, Inc., a regislered professional engineering company, <br /> whc submitted that lhe existing timber retaining wall under the deck must be <br /> removed and replaced with another retaining wall. (exhibit 7, geotechnical <br /> assessment) A temporary post has been placed to hold up the deck unlil the <br /> new retaining wall is built. (exhibit 6, narrative) <br /> 8. In addressing the failing retaining wali, the Applicanis had a survey conducted. <br /> The findings of the surveyor were that lhe deck and residence are approximately <br /> 12.09 feet from the front property line and 3.32 feet from the north side properly <br /> line. (exhibit 5, survey) The Applicants seek variances to allow replacement of <br /> lhe retaining wall and io retain setbacks that were developed at the time of <br /> construclion. (exhibit 7, geotechnical assessment) <br /> 9. Crescent Avenue right-of-way is a 60-foot right•of-way that has an approximate <br /> 20-fool paved width. The driveway lo the subjecl property, �hich is off Crescent <br /> Avenue, approaches the subject property at an angle. Parking is located on the <br /> driveway in a tandem fashion. No changes lo this access would result (rom the <br /> grant of the variances. (exhibit 1, sta(f report; testimony of Ms. Firnstahl) <br /> 10. Tlie propo�ed deck would be conslrucled over the exisling driveway and would <br /> maintain the same setback as the existing residence. No changes are being <br /> proposed to the residence. The residence, which has been on-site for over 30 <br /> years, has not cr�ated any significant detrimenlal impact to the subject property <br /> or to other properlies in the area. However, <br /> the deck wili be set back siynificanlly from the developed right-of-way and would <br /> not be near struclures on adjoining properties.
