Tlie residence was constructed long before the Applicants purchased it in 2005. <br /> jtestimony of Lisa Bemrose) A Certificate of Occupancy �vas issued fcr the <br /> subject property on June 10, 1980. The original site plan indicated that the <br /> slructure satisfied the then required 20-foot front setback and five-foot side <br /> setback of the R-1 zone. The subject property remains zoned R-1, but ihe <br /> setback standards have changed. (exhibit 1, staff report) <br /> 6. The subject property is a long and narrow wedge shaped lot that is approximately <br /> 11,180 square feet in area. Much of tF�e property is highlighted by a steep sioped <br /> area that includes vegetation with a significant number of large evergreen trees. <br /> A residence is developed on the northeast corner cf the lot near the base of the <br /> slope. The slopes are a limiting element of the property and in places are in <br /> excess of sixty-five percent. (exhibit 1, staff reporr) <br /> 7. The Applicants consuited the Jason Engineering I <br /> and Consulling Business, Inc., a registered professional engineering company, I <br /> who submitted that the existing timber retaining wall under the deck must be <br /> removed and replaced with another reiaining wall. (exhibit 7, geotechnical <br /> assessment) A temporary post has been placed to hold up the deck until the <br /> new retaining wall is builL (exhibit 6, narrative) <br /> 8. In addressing the failing retaining wall, lhe Applica+its had a survey conducted. <br /> The findings of the surveyor were that the deck and residence are approximetely <br /> 12.09 feet from the front property line and 3.32 feel from the north side property <br /> line. (exhibit 5, survey) The Applicants seel< variances lo aliow replacement of <br /> the retaining wail and to retain setbacks that were developed at the time of <br /> conslruction. (exhibit 7, geotechnical assessment) <br /> 9. Crescent Avenue righi-of-way is a 60-foot right-of-way that has an approx�mate <br /> 20-foot paved width. Tlie driveway to the subject property, which is off Crescent <br /> Avenue, approaches the subject property at an angle. Parking is located on the <br /> driveway in a iandem fashion. No changes to lhis access would result from the <br /> grant of the variances. (exhibit 1, staff reporf; testimony of Ms. Firnstalil) <br /> 10. The proposed deck wouid be constructed over the existing driveway and would <br /> maintain the same setback as the existing residence. No changes are being <br /> proposed to the residence. The residence, which has been on-site for over 30 <br /> years, has not created any significant delrimental impact to the subject property <br /> or to otl�er properties in the area.
