2. The three variances addressed in ihe findings of this document are necessary <br /> because of exceptional and extraordinary circumsiances. The extraordinary <br /> circumstances include the topogrzphy and location of ihe subject property, the <br /> previous development that occurred approximately 30 years ago and the change <br /> in the zoning slandards since the property was developed. The variances are <br /> needed to repair and upgrade the structure on-site. (findings 6 through 10) <br /> 3. The requested variances will not be materially detrimental to the property or to <br /> the general area in which it is located. (iinding 11) <br /> 4. The graniing of the variances will allow the Applicants to develop ihe subject <br /> property in a manner that it has historically been developed and in a manner that <br /> is similar to other properiies in the general vicir�ity. (finding 12) <br /> 5. The granting of the varian�e� is the minimum necessary to allow the subject <br /> property the general rights of other property owners in the area. (finding 13) <br /> 6. The proposed variances are consistent with the goals and policies of the Everelt <br /> General Comprehensive Plan. The variances do not increase the density as <br /> projected by General Comprehensive Plan designation and allow for the existing <br /> single-family residence to be consistent with other single-family residences within <br /> the City. (finding 14) <br /> 7. The proposed variances are not the result of a self-created hardship. (findings <br /> 15 & 17) <br /> DECISION <br /> [3ased upon the preceding Findings of Fact and Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that the Applicants' <br /> requesl for a variance to reduce tl�e required 20-foot front setback at 4302 Crescent <br /> Avenue, Everett, Washington to 12.09 feet is granted. A variance from the required <br /> five-foot side setback from the north inter�or property line is granted for a reduciion to <br /> 3.32 feet. A variance for an uncovered deck to exceed 42-inches above grade and <br /> encroach into a front setback area in excess of fifty-percent of the required setback <br /> deptli is granted. These va�iances are granted subject to the conditions as listed <br /> lierein. <br /> 1 . Any further development on ihe subject property must satisfy the current <br /> setbacks of ihe R-1 zone. <br /> 2. Any development of the subject property, including that activity for which ihe <br /> varian.:es are granted, requires construction permits from the City of Everett. All <br /> construction must comply with the current City of Everett building codes. <br /> 6 <br />
