Washington State law prohibits the Building Official from allowing the design of the building to meet
earlier less restrictive codes: A facility that has been vacated for more than thirty days, or for which
the license has expired, shall be considered a new facility required to meet current codes, per WAC
212-12-005.
These comments address building issues only. Revisions or additions may be required by other
departments (Utilities, Public Works, or Planning).
Should you decide to proceed with a building permit application, all required submittals must be of
sufficient detail and information to ensure that the proposed structure will be constructed in compliance
with all adopted codes. Code references cited include the 2009 International Building Code (IBC), the
2009 Washington State Energy Code (WSEC), and the 2003 Accessible and Usable Buildings and
Facilities A117.1-2003 (ICC/ANSI). All codes referenced, as amended by the City of Everett, should
include current adopted and revised codes (RCW) of the State of Washington.
