,_ .__�_..._....�_.. --- - <br />I <br />• everett <br />: '' � W.O.Ii` — <br />,�/ n > �A�e� . <br />Proper:y Address <br />COVENANT CONSENTIrTG TO FORMATION <br />OF A LOCAL IMPROVEMENT DISTRIGT <br />WHEREAS, , here[n- <br />atter reterred to as "Owner;' owns certain property within the City of Everett <br />legally described es follows: �o.T. � ���.r. d�F �.� ( <br />�F �r � J�trr�S 2No h-f�nrTia-�.) <br />�9HEREAS, Owner has appIIed for a permit from the City of Everett which <br />under Ordinance No. 555-78 and Ordinance No. 665-80 require certain improve- <br />ments to be made to public rights of way as a condition to issuance of certain City <br />permits; said Ordinances allovr that the City Engineer may accept a covenant <br />consenting to the formation of a locsl improvement district in lieu of having Owner <br />construct and install the required public improvements when, in the opinion ot the <br />CIty Engineer, certain actual improvements are not des[rable due to known or <br />perceived physical problems or the need ;or more comprehensive improvements; <br />WHEREAS, Owner's property end the adjacent public rights of way haqe <br />been determined to require a covenant consenting to the formation of a local <br />improvement district rather than having Owner make specific improvements. , <br />NOW, THEREFORE, in consideration of issuance of applicable City <br />permit(s) pursuent to Ordinar^.e No. 555-78 and Ordinance No. 665-80 and in lieu <br />of certain public right of way improvements Owner consents to the formation of a <br />local improvement district hereafter formed by the City or its successors or other <br />property ownecs for the public improvement of: <br />t, �. ��.... . . <br />Jdcr �� a- � A9n� i <br />or a portion thereof including street improvements defined in Ordinance Nas. <br />555-78 and 665-80 to include: ' <br />The insfallation of all public facilities required to improve the street <br />to City design standards including grading, drainage, pavement, <br />curb/gutter, sidewalk, street L•ghts, traffic signals and other neces- <br />sary appurtenances. Such street improvements shall not be limited to <br />the half street abutting the property; far example, where no per- <br />menent street improvement existed, the street improvement shall be <br />extended beyond the centerllne a sufficient distance (10 ft. minimum) <br />to pecmit safe movement of traffic. <br />ThLs Covenant consenting to the formatton of a local improvement district <br />epplies (and precludes legal protest) only to the formation of a local improvement <br />dtsfrict, Owner executing this document retains its, his/her or their rights under <br />law to provide input or to make objection to the scope of the Froposed public <br />improvements to be accomplished by such local improvement district inciuding <br />nature and type of improvements as well es the proposed or final benefits and <br />assessment therefor. <br />The City shall deliver a sirned release of this Covennnt to Owner after <br />comple;ion of public improvements as described hereinabov� through the formation <br />ot a local improvement district and after transmittal of tne final assessment role <br />to the County of Snohomish pursuant to law. The City may not utilize this <br />Covenant for the formation of more than one (1) local improvement district. <br />This Covenant consentiop, to the formation of a.Iocal improvement district <br />shall be a covenant touching, �oncerning and running with the land and shall be <br />bindi ig on Owner's heirs,. assigns or successors in interest. <br />
