Proper:y Address COVENANT CONSENTIrTG TO FORMATION OF A LOCAL IMPROVEMENT DISTRIGT WHEREAS, , here[n- atter reterred to as "Owner;' owns certain property within the City of Everett legally described es follows: �o.T. � ��.r. d�F �.� ( �F �r � J�trr�S 2No h-f�nrTia-�.) �9HEREAS, Owner has appIIed for a permit from the City of Everett which under Ordinance No. 555-78 and Ordinance No. 665-80 require certain improve- ments to be made to public rights of way as a condition to issuance of certain City permits; said Ordinances allovr that the City Engineer may accept a covenant consenting to the formation of a locsl improvement district in lieu of having Owner construct and install the required public improvements when, in the opinion ot the CIty Engineer, certain actual improvements are not des[rable due to known or perceived physical problems or the need ;or more comprehensive improvements; WHEREAS, Owner's property end the adjacent public rights of way haqe been determined to require a covenant consenting to the formation of a local improvement district rather than having Owner make specific improvements. , NOW, THEREFORE, in consideration of issuance of applicable City permit(s) pursuent to Ordinar^.e No. 555-78 and Ordinance No. 665-80 and in lieu of certain public right of way improvements Owner consents to the formation of a local improvement district hereafter formed by the City or its successors or other property ownecs for the public improvement of: t, �. ��.... . . Jdcr �� a- � A9n� i or a portion thereof including street improvements defined in Ordinance Nas. 555-78 and 665-80 to include: ' The insfallation of all public facilities required to improve the street to City design standards including grading, drainage, pavement, curb/gutter, sidewalk, street L•ghts, traffic signals and other neces- sary appurtenances. Such street improvements shall not be limited to the half street abutting the property; far example, where no per- menent street improvement existed, the street improvement shall be extended beyond the centerllne a sufficient distance (10 ft. minimum) to pecmit safe movement of traffic. ThLs Covenant consenting to the formatton of a local improvement district epplies (and precludes legal protest) only to the formation of a local improvement dtsfrict, Owner executing this document retains its, his/her or their rights under law to provide input or to make objection to the scope of the Froposed public improvements to be accomplished by such local improvement district inciuding nature and type of improvements as well es the proposed or final benefits and assessment therefor. The City shall deliver a sirned release of this Covennnt to Owner after comple;ion of public improvements as described hereinabov� through the formation ot a local improvement district and after transmittal of tne final assessment role to the County of Snohomish pursuant to law. The City may not utilize this Covenant for the formation of more than one (1) local improvement district.
