Froperty Address COVENANT CONSENTING TU FORMATION OF A LOCAL IMPROVEMENT DISTAICT WHEREAS, 1 herein- after re[erred to as "Owner;' owns certain property within the City of Everett legally deseribed as follows: �G.�-. � 2��z- y� .p�� G � F f= G� +�t�{ s �..� o h nl�rTt c�.l WHEREAS, Owner has appIIed for a permit from the City of Everett which under Ordinance No. 555-78 and Ordinance No. 665-80 require certain improve- ments to be made to public rights of way ns a condition to issuance of certain City permits; said Ordinar.ces ellow that the City Engineer may accept a covenant consenting to the formation of a local improvement district in lieu of having Owner construct and install the required public improvements when, in the opinion of the City Engineer, certain actual improvements are not desirable due to known or percetved physical problems or the need for more comprehensive improvements; WHEREAS, Owner's property and the adjacent public rights of way haqe been determIned to require e covenant consenting to the formation of a local improvement district rather than having Owner mak�_ specific improvements. _ NOW, THEREFORE, in eonsideration of issuance of applicable City permit(s) pursuant to Ordinance No. 555-78 and Ordinance No. 665-SO and in lieu of certain public right of way improvements Owner consents to the formation of a local improvement district hereafter formed by the City or its successors or other property owners for •:he public improvement of: . m. �• .■ . i . .,._..� ,. �-J /i9n � or a poction thereof including street improvements defined in Ordinance Nas. 555-78 and 665-80 to inciude: ' The installation of all public facilities required to improve the street to City dcsign standards including grading, druinage, pavement, curb/gutter, sidewalk, street lights, traffic signais and other neces- sary appurtenances. Such street improvements shall not be limited to the half street abutting the property; for example, where no per- menent street improvement existed, the street improvement shall be extended beyond the centerline a suf£icient distance (10 ft. minimum) to permit safe movement of traffic. ThLs Covenant consenting to the formation of a local improvement district appIIes (and precludes legal protest) only to the formation of a local improvement district, Owr.�r executing this document retains its, his/her or their rights under ]aw to provide input or to mnke objection to the scope of the proposed public improvements to be accomplished by such locnl improvement district inclu�ing nature and type of improvements as well as the proposed or final benefits and assessment therefor. The CIty shall deliver a signed releflse of ihis Covenant to Owner after completion of public improvements as described hereinnbove through the formation oi a loct+l improvement district 8nd after transmittal o€ the finai assessment role to the County of Snohomish pursuant to law. The City may not utilize this Covenent for the formation of more than one (1) local improvement district. This Covenant consenting to the formation of a.
